SUMMARY OF PROPOSED ACTION On behalf of the Korean United Presbyterian Church of Seattle, Shelly Choi has applied for a conditional use permit to expand the existing Yunhap Preschool at the UPC's multi -use Vision Dream Center building at 8505 240"' Street (Exhibit 1). There is currently a morning preschool program for 11 children at the site. The intent of this conditional use permit is to allow expansion of the preschool to include up to 50 children, five days per week, from 9:OOAM to 1:30PM as well as before/after care from 7:OOAM to 9:OOAM and 1:30PM to 6:OOPM (Exhibit 2). ECDC 16.20.01 O.D. l requires a Conditional Use Permit for a preschool as a secondary use in the Single Family Residential (RS -8) zone. II. GENERAL INFORMATION A. Proposed Use: The applicant is proposing an expanded preschool as a secondary use to the existing primary use of the site which is religious worship. H. Existing Use: The Vision Dream Center currently hosts a weekday morning preschool program that serves 11 children (currently considered a permitted secondary use as a family day-care under ECDC 16.20.010.B.8). ■it. `/ .; :. 61 10"RalllWlAl The application was submitted on February 6, 2009 and was determined to be "incomplete" on February 18, 2009. The applicant submitted the requested information on April 7, 2009, and the application was determined to be "complete" at that time. A notice of public hearing was mailed to the applicant on April 30, 2009. IV. SEPA THRESHOLD DETERMINATION The application for a conditional use permit does not require SEPA review; therefore, the applicant and the City have complied with the requirements of ECDC 20.15.A. V. PUBLIC HEARING NOTICE A "Notice of Development Application" was published in the Herald Newspaper and was posted at the subject site, Public Safety Complex, Development Services Department, and Library on February 19, 2009. This notice was also mailed to residents within 300 feet of the site on February 19, 2009, using a mailing list provided by the applicant with the initial submittal of the application. A "Notice of Public Hearing" was published and posted on May 20, 2009, in the same way as the prior notice. An affidavit of publication for the public hearing notice was not received in time to include with the staff report. The City has complied with the noticing provisions of ECDC 20.91 (Public Hearings and Notice). VI. TECHNICAL COMMITTEE This application was evaluated by the City's Building and Engineering Divisions as well as the Fire, Public Works and Parks and Recreation Departments. The Public Works and Parks and Recreation Departments had no comments on the proposal and the Fire Department noted that they had no comment at this time but would during review of any subsequent building permit. The Building Division noted that both a Change of Use permit and Fence permit will be needed to implement the expanded preschool (Exhibit 14). The Engineering Division indicated that no additional traffic impact fees are required at this time since PM Peak Hour Trips will total less than 25 (Exhibit 15) and those trips had previously been reviewed in 2003 as part of the Vision Dream Center conditional use permit. Any increase in PM Peak trips would require an updated Traffic impact Assessment and additional mitigation fees. VII. NATURAL ENVIRONMENT A. Critical Areas: A Critical Areas Checklist was submitted in 2003 and a waiver from further study was issued at that time. B. Topography, Soils, Wildlife, and Vegetation: With the exception of enclosing an existing play area with a fence, no exterior changes to the site are proposed. Page 2 of 6 VIII. NEIGHBORHOOD CHARACTERISTICS The bulls of the general area between Edmonds Way (SR -104) and Highway 99 that is south of Esperance (unincorporated Snohomish County) was annexed by the City in 1994. The four -acre project site is located between 238"` and 2401" Streets Southwest between Edmonds Way and 84th Avenue West (see zoning map at right). The existing church buildings on the northern half of the site are addressed off 238"' (8506 238t' St. SW) and the new multi -use building on the southern half of the site is addressed off 240`'(8505 240`h St. SW). Parcels zoned RS -8 immediately surround the church site and are developed with single family residences. Multifamily residential exists further from the site along Edmonds Way and to the south across 240"' St. Further to the east across 84`h Avenue is an area zoned General Commercial (CG) that abuts Highway 99. The area is well -served by existing arterial and collector streets. IX, COMPREHENSIVE PLAN Yunhap Preschool File No. CU -2009-02 The majority of the subject site is designated `Single -Family — Urban 1' in the Comprehensive Plan (see Plan map to the right). The parcels immediately surrounding the site have a similar designation. A very small portion of the southwestern portion of the site is designated `Edmonds Way Corridor' which is the primary designation along the length of Edmonds Way. East of 84'h Avenue West is designated `Highway 99 Corridor'. The City of Edmonds Comprehensive Plan has a vision for residential development, excerpts of which are included below: .019 Protect residential areas from incompatible land uses through the careful control of other types of development and expansion based upon thefollowing: B.5.a Residential privacy is afundamental protection to be upheld by local government. B.5. b. Traffic not directly accessing residences in a neighborhood must be discouraged. B.5.c. Stable property values must not be threatened by view, traffic or land use encroachments. B.S.d. Private property must be protected from adverse environmental impacts of development including noise, drainage, traffic, slides, etc. The proposed preschool is a compatible use given the site's Comprehensive Plan designation and fits well within the context of the existing developed site and available access. The City's Page 3 of 6 Yunhap Preschool File No. CU -2009-02 regulations for Single Family Residential zones recognize that churches are compatible uses within the single-family residential environment. X. PUBLIC COMMENTS To date, no public comments have been received on the subject proposal. XI. APPLICABLE CODES A. ECDC 16.20 RS — Single FamA Residential Pursuant to ECDC 16.20.010.D.1, preschools are secondary uses that require a conditional use permit. The applicant has filed the subject application for a conditional use permit in compliance with ECDC 20.05. ECDC 16.20.000.13 indicates that one purpose of the RS zone is, "To provide for additional nonresidential uses which complement and are compatible with single-family dwelling use. " If this permit is approved, the preschool use would be consistent with ECDC 16.20. B. ECDC 17.100.020 {Community Facilities- Churches) ECDC 17.100.020.1 indicates the following regarding secondary uses on church properties: (1) Any use otherwise allowed or conditionally permitted within the particular zone in which the church is located, may be allowed as a secondary use; provided, that the conditions of subsections (1)(2) and (3) of this section are met. (2) 1f the proposed secondary use is a conditional or nonconforming use in the zone in which the church is located, then a conditional use permit shall be required for such secondary use. (3) A use shall be considered secondary only where the use is subordinate to the primary use of free worship, with respect to at least two of the following criteria: a. The amount of space allocated to the use; b. The duration of use; or c. The number of people served or involved in the use. Approval of the subject permit will satisfy ECDC 17.100.020.1.2. With respect to ECDC 17.100.020.1.3, since the amount of space allocated to the preschool and the number of children to be served are both less than the amount of space allocated to the worship services and the number of people involved in religious services at the site, the proposed preschool use is considered secondary to the primary use of the church facility. C. ECDC 17.50 (Off Street Parking Regulations) ECDC 1750.020.C.8 requires daycare centers and preschools to provide parking at a rate of one space per 300 square feet, or one per employee, plus one per five students, whichever is larger. The plans submitted by the applicant indicate that the indoor area to be used by the preschool is approximately 4,577 square feet while the outdoor play area will be 2,600 square feet. Calculating one space per 300 square feet of this total area results in a requirement for 24 parking spaces. It is uncertain exactly how many employees will work at the preschool but even if the parking space per employee/pupil ratio resulted in a parking requirement slightly greater than 24 spaces, the site has more than 120 parking spaces available during the hours of preschool operation (Exhibit 3). Page 4 of 6 Yunhap Preschool File No. CU -2009-02 D. ECDC 20.05 (Conditional Use Permits) ECDC 20.05.010 contains the following review and approval criteria for Conditional Use Permits: A. That the proposed use is consistent with the Comprehensive Plan. B. That the proposed use, and its location, is consistent with the purposes of the zoning ordinance and the purposes of the zone district in which the use is to be located, and that the proposed use will meet all applicable requirements of the zoning ordinance. C. That the use, as approved or conditionally approved, will not be significantly detrimental to the public health, safety and welfare, and to nearby private property or improvements unless the use is a public necessity. D. The hearing examiner shall determine whether the conditional use permit shall run with the land or shall be personal. If it runs with the land and the hearing examiner finds it in the public interest, the hearing examiner may require that it be recorded in the form of a covenant with the Snohomish County auditor. The hearing examiner may also determine whether the conditional use permit may or may not be used by a subsequent user of the same property. The applicant has submitted a Criteria Statement (Exhibit 2) outlining how the proposal meets the above criteria. Staff generally agrees with the applicant's description. No signage has been proposed with this permit. If signage for the preschool is desired, a building permit is required as is compliance with ECDC 20.60 (Signs). XII. CONCLUSIONS A. As indicated in Section IX of this report, the proposed preschool is consistent with the City's Comprehensive Plan. B. As discussed in Section XI, the expanded preschool is consistent with the City's zoning code as long as the proposed conditional use permit is approved. Existing access to the site and parking at the site are adequate. C. As proposed, the preschool does not appear to be detrimental to the neighborhood since it will be located in and around the existing Vision Dream Center. The hours of preschool operation will not conflict with the religious uses of the site. D. This permit should be personal to the applicant and not run with the land. XIII. RECOMMENDATION Based on the analysis and Exhibits with this report, staff recommends APPROVAL of the conditional use permit for the Yunhap Preschool with the following conditions: A. The applicant shall limit the preschool's days of operation to Monday through Friday. The preschool shall not be operated on weekends to avoid any parking conflicts with the church's worship services. B. Enrollment in the preschool shall not exceed 50 children. Enrollment in the before/after school program shall not exceed 25 children. Any increase in the preschool or before/after enrollment shall require a new conditional use permit. C. The permit shall be personal to the Korean United Presbyterian Church of Seattle and shall not run with the land. Page 5of6 Yunhap Preschool File No. CU -2009-02 D. This application is subject to the applicable requirements contained in the Edmonds Community Development Code (ECDC) and it is the responsibility of the applicant to ensure compliance with the various provisions contained in these ordinances. Our primary goal of the. preschool/daycare center is to provide the quality care at an affordable price to the families with children, under the theme of `Raising Little Heroes.' Page I of 3 Exhibit 2 Yunhap Preschool (CU -09-02) The proposed use of preschool within the church does not infringe into the neighboring residences or invade their privacy. The proposal simply invites neighbors' children to learn under the allotted hours permitted. The increase in traffic is minor compared to the traffic generated for worship services or other events. Also because operating hours for the day care center will not overlap with church hours, there always be plenty of parking for day care center. Traffic not directly accessing day care center or the church will have no business on this property. Unwanted parking is of no concern. Stable property values will not be threatened by view, traffic or land use encroachments because the proposed use does not involve physical change in terms of building addition to the property. Proposed use protects neighboring properties from adverse environmental impacts of development. The proposed use will not generate any unwanted noise or any infrastructure changes that might affect the natural terrain of the site. Since the building is recently built and permitted, there is no need for structural or exterior modification or plan to the existing facility. 3. Zoning Ordinance: Korean United Presbyterian Church of Seattle is located within the Single Family Residential (RS -8) zone. Pursuant to ECDC 16.30.010.D.1, compliance with ECDC 20.05 is required to allow the establishment of a preschool/daycare center as a second use in the Single Family Residential (RS -8) zone. Thus, we have applied for a conditional use permit to locate a preschool/daycare center in the Single Family Residential (RS -8) zone. As stated in ECDC 16.20.000.13, one purpose of the RS zone is, "To provide for additional nonresidential uses which complement and are compatible with single-family dwelling use." If granted, this land use would be consistent with ECDC 16.20. Page 2 of 3 Additional information: Preschool will be located on the base floor of the building. Ages of Preschoolers: 2 & 1/2 to 5 years. Hours of Operation: 7:00 — 9:OOam Before School Care 9:00 — 1:30pm Preschool 1:30 — 3:OOpm Rest/ Nap Time 3:00 — 6:OOpm After School Care Our primary plan is to do the preschool and not a daycare, hence we'll not have more than 25 children in the before/after school care whereas the enrollment of the preschool may be up to 50 children. The reason for before/after school care is that we just want our preschool to be available for the working parents. It is anticipated that only a fraction of the total number of students would attend before/after school parts of the preschool program. In addition, since we're planning to be licensed by the state, we had a center licensor, Diane Smith to visit our facility for the necessary changes to be licensed to provide extended program. She was impressed of our facility and encouraged us to precede our plan for the preschool. By the State of Washington Licensing Guideline and state licensor, Diane Smith, (referred to WAC 170-295-0080) approximate allowed # of preschoolers on the first floor is 52 due to the number of toilets available. However we will limit our numbers below the guideline to provide quality care/program. The important point that needs to be reminded again is the reason for our plan for the preschool/daycare is for the families in the local communities. We saw the great need for a quality preschool program for those who don't qualify for the state preschool program but financially struggling to pay the other regular preschool tuition. Our primary goal is to provide a quality preschool program at an affordable price to those families in our local community. Our church is willing to dedicate the new building for this plan. And now we're just asking for the city's permission to make this happen. The KUPC is located at 8506 238t' St SW in Edmonds, Washington Project Description As we understand, the proposed preschool/daycare activities would take place on the bottom floor of the existing Vision Dream Center, a support building for the existing church constructed in 2007. The church currently has weekday preschool activities that occur at the Vision Dream Center between 9:30 am and 1:30 p.m. There are currently 11 children enrolled in the preschool. The church currently has no daycare services. The proposed project would consist of adding before- and after-school daycare services, with enrollment in the daycare program of up to 25 children. Proposed hours of the daycare are planned to be. 7:30 a.m. to 9.30 a.m-, and 2:00 p.m- to 6:00 p -m. We understand that future enrollment in the preschool could increase to up to 50 children, but the hours of the preschool would remain outside of the typical street peaks of 7-9 a.m. and 4-6 p.m. Trip Generation The trip generation estimate for the proposed daycare use was based on the rates published in the ITE Trip Generation Manual, 80' Edition, for Land Use Code (LUC) 565 Day Care Center. The existing and future preschool use does not generate any peak hour traffic since the hours of operation are entirely outside of the typical street peaks of 7-9 a -m. and 4-6 p.m_ The weekday p.m. peak hour trip generation estimate for the daycare use is summarized in Table 1.
