SUBJECT: REQUEST FOR ADDITIONAL INFORMATION FOR YOUR CONDITIONAL
USE PERMIT APPLICATION, PLN20130012
Dear Ms. Krumora:
Staff has begun review of your land use application for a conditional use permit at 24310 76"' Ave. W;
however, it was found that your application is incomplete. Please submit the following items at your
earliest convenience so that staff can continue processing your application:
The subject site is located within the Community Business, BC, zone, which allows for daycare
centers as a primary use requiring a conditional use permit. Your written description of the
proposed use indicates that the proposal is for a preschool and summer camp facility; however, in
order for the conditional use permit to be approved, the proposed use would need to be consistent
with the definition of a daycare center. Edmonds Community Development Code (ECDC)
Section 21.20.010 defines a daycare center as "A building or portion thereof used for the care of
children under the age of 12 located in a facility which accommodates 13 or more children
regardless of whether such services are provided for compensation." Please provide
documentation as to whether the proposed use will be consistent with this definition.
2. Please submit a written explanation of how your proposal complies with the conditional use
permit review criteria of Edmonds Community Development Code (ECDC) Section 20.05.010,
which are as follows:
20.05. 010 Criteria and findings.
No conditional use permit may be approved unless all of the findings in this section can be made.
A. That the proposed use is consistent with the comprehensive plan.
B. Zoning Ordinance. That the proposed use, and its location, is consistent with the purposes of the zoning
ordinance and the purposes of the zone district in which the use is to be located, and that the proposed use
will meet all applicable requirements of the zoning ordinance.
C. Not Detrimental. That the use, as approved or conditionally approved, will not be significantly
detrimental to the public health, safety and welfare, and to nearby private property or improvements unless
the use is a public necessity.
D. Transferabilhty, The hearing examiner shall determine whether the conditional use permit shall run with
the land or shall be personal. If it runs with the land and the hearing examiner finds it in the public interest,
the hearing examiner may require that it be recorded in the form of a covenant with the Snohomish County
auditor. The hearing examiner may also determine whether the conditional use permit may or may not be
used by a subsequent user of the same property.

Please submit the above information as soon as possible, so that staff may continue processing
your application. Please keep in mind that a complete response to this information request
must be received within 90 days or the application will lapse for lack of information (ECAC
20.02.003.D). Thus, your application will expire if the requested information is not received by
July 1, 2013.
