The City is in receipt of your request for waiver from sidewalk construction requirements, dated
March 24, 2008, for the Lybeck 2 -lot short plat located at 808 Daley Street. While sidewalks
are required as a condition of approval per the Sidewalk Construction Policy contained in the
adopted December 2002 update to the City of Edmonds Transportation, Plan and ECDC
18.90.030, you have requested that the City review this project site and code requirements for a
determination of economic unfeasibility (Sidewalk Construction Policy 32b).
As stated in your letter, there are existing steep slopes on and adjacent to the subject site. The
existing Daley Street right-of-way connecting 8th Ave N to 91h Ave N is currently undeveloped
and will likely remain as such. A walking path has been constructed through this portion of the
undeveloped right-of-way, but does not provide an ADA accessible pedestrian path to 9th Ave
N. Construction of sidewalks adjacent to the subject property would also not comply with ADA
standards without significant re -grading of the right-of-way and construction of retaining walls.
The City agrees that it would be economically unfeasible for this development to incur such
costs.
Furthermore, two other short plat developments constructed within the last 3 years and located
within the vicinity of this project were granted waivers from the requirement of sidewalk
construction. The first, located north of the subject development at 509 9"' Ave N, received a
sidewalk construction waiver for that portion, of the property fronting 8`f'
Ave N. As portions of
81M
Ave N have been vacated between the subject property and the closest sidewalks on 81h Ave
N no link would be provided to other existing sidewalks on 81h
Ave N. The second, located west
of the subject development at 716 Daley Street, received a sidewalk construction waiver for that
porition of the property fronting Daley Street,
The City of Edmonds has determined that sidewalks will not be required as a condition of
development for the construction of the subject short plat and subsequent single family
residences at 808 Daley Street due to economic unfeasibility.
