The City has received a request for code enforcement regarding the business activities at 8609

and 8611 244 St. S.W. Inspection has shown that there is a paving and/or construction business
taking place at and between the two parcels. The property is zoned single family, RS-8.
The regulations relating to the subject property’s current use in the Edmonds Community
Development Code (ECDC) are as follows:
ECDC 4.72.020 Business license required.
It shall be unlawful for any person to operate, engage in or practice any business in the city of
Edmonds without first having obtained a business license from the city. If more than one business
is located on a single premises, a separate license shall be required for each separate business
conducted, operated, engaged in or practiced. \[Ord. 3282 § 1, 1999; Ord. 1139 § 1, 1965\].
ECDC 17.50.100 Commercial vehicle regulations (in residential zones).
A. No person shall park or store more than one commercial vehicle or any commercial vehicle
over 10,000 pounds licensed gross vehicle weight per dwelling unit on any lot in any R zoned
district unless he/she has first obtained a conditional use permit. For the purposes of this section,
“commercial vehicle” means any motor vehicle, the principal use of which is the transportation of
commodities, merchandise, produce, freight, vehicles, animals, passengers for hire, or which is
used primarily in construction or farming, including but not limited to bulldozers, backhoes,
tractors and cranes.
ECDC 20.20 - Home occupations are a permitted use in residential zones but do require a
business license and home occupation permit. There are seven criteria that must be met to obtain
an administrative home occupation permit. If a home occupation proposal doesn’t meet one or
more of the criteria the property owner may apply for a conditional use permit. Please note that
the current level of commercial activities at the subject properties would require a conditional use
permit. There is no guarantee a conditional use permit will be granted if an application is
submitted. If a conditional use permit is denied then the commercial activity must cease. A
Home Occupation handout is enclosed for your review.

Corrective actions required:
Please contact me by November 6, 2006 at 425-771-0220 to respond to the information
above and to review your compliance schedule. A non-response would initiate an Order
to Correct Violation Notice.
If you are interested in running a commercial business at these locations, please make a
full application for a City of Edmonds business license and home occupation permit by
November 15, 2006. Please note that a home occupation can only apply to the current
resident at the subject property. The outside storage and commercial equipment and
vehicles would be addressed and resolved during the home occupation review. An
Edmonds Business License application is being mailed to you from the City Clerk’s
Office or you can pick one up yourself on the first floor of City Hall.
Otherwise, without a home occupation permit, any business must cease and any
commercial equipment or commercial vehicle over the quantity of one and/or over
10,000 pounds gross weight would need to be removed by November 30, 2006.
