Box 1823 Lynnwood, WA 98046 Case # ZE-09-187 (COD20090065) Subject Property: 22815 Edmonds Way, Edmonds, WA. 98020 Dear Mr. Dawson, The City received a complaint regarding the selling of yard art statues, vehicles and boat and a request to investigate land-use violations at the property. Research on the Architectural Design Board (ADB) process and requirements of the zone revealed the following issues: The ADB staff report and the submitted site plan indicated that that there would only be the elephant and · giraffe structures at the sight. The animal structures were specified as art/structures, not as products for sale. · Numerous animal/structures have been added either as additional art or as products for sale. Most of these · structures are located in the setbacks. A primary concern of Staff and the ADB Board was the possible distraction to traffic of the animals. Because the only animals specified for the site, the elephants and giraffes, were down in the parking area and setback 15 feet, the distraction was considered mitigated. The additional animals renew the concern that traffic could be distracted. Signs have been added that the animals are for sale. · Parking vehicles and/or boats in the parking lot for sale restricts ingress/egress and parking. · A temporary building has been added into the setback and as an additional business. The building was not · indicated on the application submitted to the ADB or specified on the City business license application. Corrective actions required by October 20, 2009: Remove additional art-structures, signs related to selling art-structures, and the temporary building or; · Make a complete application for a revision of ADB-06-143 indicating the site/business plan that you intend · to implement. Refrain from using the parking lot areas as a location for vehicle and boat sales so that parking and · ingress/egress are unaffected.
