According to the complaint, you are renting rooms that have private entrances, no full-house access and kitchenette facilities for cooking/eating. Building permits are required for most changes necessary to create an ADU. The renting of rooms without kitchens is a permitted use in single family zones. A kitchen is defined as “any room used for cooking or preparation of food”. (kitchenette, refrigerator, microwave, etc. included in rooms without access to the main house kitchen) A rental room providing kitchen facilities is considered an ADU. One (1) ADU is a permitted secondary use in single family zones but doe require a conditional use permit and any associated construction permits. The City does not have a permit for an ADU on file for this site. Corrective actions required: Please contact me at your earliest convenience by December 9, 2009 to respond to this letter and advise your · compliance plan. If there is no response an Order to Correct would be issued. Cease the renting of rooms with kitchens; · If you choose to continue to rent rooms, but without kitchens, an inspection would be required to o confirm that the kitchens have been removed. An alternative to this is to sign and record on title a “statement on accessory dwelling units”. Or please submit a complete application and fees by December 31, 2009 for one (1) ADU. · Obtain a permit for non-exempt construction such as walls or plumbing (kitchen, bathroom) o developed to create the ADU’s. The enclosed Accessory Dwelling Unit handout describes the requirements and criteria to establish an ADU. The enclosed Work Exempt handout notes the type of construction work that is exempt from permit requirements.
