Page PO Box 984 Edmonds, WA 98020-0984 February 11, 2015 The Development Services Department 2"d Floor City Hall — 121 5th Ave. N Edmonds, WA 98020 To The Development Review Committee: The proposal is for a coffee shop that would encompass the west 20 feet of my building on Puget Dr. As far as construction goes, the only physical addition to the building would be a drive -up window which would be about 4 ft. wide and about 3 ft.deep. Some plumbing and electrical would be re-routed but that is of little concern at this time. The two concerns for me are the conditional use permit and the parking. If you follow the red arrows on the site plan, you can see how the traffic flow will facilitate a successful turnaround. I would eliminate five parking spaces on the west side of the building and if necessary, change the parking on the south side of the building from horizontal to diagonal in order to make extra parking spaces (indicated in green on the site plan). And about the architect, I'm sorry but we are not allowed to make recommendations for contractors or designers. You may have to ask around town for that. To recap just a bit, in order for a daycare to occupy your first floor, the code will require the ceiling to be fire rated, triggered by the change of use (change of occupancy.) Here is the section of the building code with the partial list of recognized uses that fall under the B occupancy that I mentioned. Please be aware that I am sending you this list simply to show you some of the other building code - approved uses you might consider that would not be a change of use for your building. It is always wise to check with the city to see if there are specific requirements or restrictions within the building code or other land use codes for future uses you are considering. For example, .I can't say whether a dog kennel (which is on the list) would be allowed by our land use code in your location; or if you put in a beauty shop, there are specific requirements for ventilation that would need to be met. If you look at the building it is evident that an additional firewall is not necessary. The Condo upstairs which my wife and I occupy has multiple ways. out in case of fire. It makes no sense to require something that is not needed. How many other day cares in Edmonds were required to do this? All of these codes appear to have been passed after I purchased the building. It's intrusive to doing business. I am in jeopardy of losing the building to the bank after 30 years of ownership. Please look for an exception that will allow us to continue. I await your reply. With the informal nature of our development review committee meetings and the limited information I had to go on, I was only able to bring up that item in general terms. I recall that the next step for you folks was to check above the dropped ceiling to see whether or not there was drywall on the ceiling, or some kind of rated system in place. Am I to take it by your description that you did not find drywall? If that is the case, I believe the code will require the ceiling to be fire rated if the first floor undergoes a change of occupancy from a business to a daycare. I have only done some preliminary checking in the building code so far; this type of situation in an existing building may take bit of digging to see what the code actually requires. I had real estate, mortgage, building services and escrow for 32 years in that spot. The new owner moved Edmond realty downtown. I have 3,800 hundred sq. ft that lends itself perfectly to a day care. I live upstairs in the condo with my wife Mindy. Frankly Rob I an amazed that the city has the power to invade every aspect of my property including what bedding plants belong in my planter boxes. Never the less I believe we can transverse The Traffic study the parking requirement the fire Marshal inspection and the horticulture requirements. all fees paid by the applicant. Right at the end of the meeting Leif Bjorback stated that we may need a fire barrier between the first and second floors. For me that is a knock out punch that would knock me and my fellow applicants out of the ball park. What is there for fire protection besides fire extinguishers, fire alarms and smoke detectors are 6 doors door leading out of the building in every direction. You would virtually'have to poor gasoline on yourself to get injured in a my building. The floor separating the upstairs is 3/4 in. exterior plywood then 3/4 solid oak throughout the building. This building was built like a brick s--- house. In the downturn of 208 - 111 lost everything and had to refinance my properties to stave of bankruptcy,I have been going backwards $5,500 a month for over a year to support that building. The building dept says maybe 4 -5 months even to get a permit. Then the work needs to be done before we get to the hearing examiner. I can handle that if we can get by this fire barrier. Going through that solid oak would give anybody plenty of time to get out of a burning building. As you can surmise Rob I'm dying financially.
