WHER> AS; the City`desires'%to purchase an easement for stormwater purposes on
and across the subject tract; an.'M1 .
WHEREAS, 6Property Owner, in the course of development of the short plat,
in accordance with the.-thgtire4ing'•.requirements of the City and its development
regulations, will be installin` formwat r ccniveyance facilities, and

1. Monetary Consideration. 1 . -r onsidera'tion of the installation of
stormwater facilities and the dedication of a uti:fity.6setiieni as described herein, the City
agrees to pay the sum of Ten Thousand Six Hundr5d Tbirty-Five Dollars ($10,635.00).
This sum shall be paid up on the later to occur 6f;_(a}•final inspection and acceptance of
the improvements described herein, and (b) recording- of the 0 division plat containing
the easement. (See 2. below.)
2. Dedication of Stormwater Utility Easement. The Property Owner shall, in
the course of the subdivision process, dedicate to public rise d Surface.• -and subsurface
utility easement, including a construction easement, both teftiporary.,64eoritinuing, for
the construction, maintenance, reconstruction and eventual reoacernent as required, of
stormwater transmission facilities. Such facilities shall be;' constructed :'ta. City
engineering standards. The subject tract over which the easement•w.ifl be.,&dicaied is
described on the attached Exhibit A. Attached Exhibit B shows 'the...16cation .of the
easement. The easement shall be contained on the face of the subdivision plat aiid.

3. Specific Enforcement. This agreement provides for purchase and
conveyance of an interest in real estate and as such, shall be specifically enforceable by

4.'..:No Limitation on Administrative Authority. Nothing herein shall be
intrprtted to contract away or limit the exercise of decision-making authority on behalf

associatod'appmrtunartces,(`piping") within the easement. Such installation shall conform
to the City engineering standards.

have an irrevocable lice 6--,e..io`enter opto the, described easement area and complete the
work. The actual costs of thc,w6ik--necessary to complete installation of the piping shall
be deducted from the sum specified.int ection 1 aad••the balance, if any, forwarded to the
Property Owner.
5.3 The Property O.wiier rpserves�ihe right in the course of subdivision
improvement constructions pursuant fo, the-.applicatiari of referenced herein, to connect
stormwater retention and detention facilities as wet Las ..downspouts and other facilities
conforming to the requirements of the City'• 7'e pieerimg aid development regulations to
the described stormwater improvements.
6. Entire Agreement - Amendment. entire• -agreement between the
parties. Any prior understandings or discussions, wr.itten'0r`nra), are deemed merged
with its provisions. This agreement shall not be amen4pd e'kept.-in writing with the
express written consent of the parties hereto.
