DECLARATION OF RECIPRICOL
EASEMENT AGREEMENT
Whereas Gilbert Construction Company LLC, a Washington Limited Liability
Company, as the fee simple owner of lots 3 and 4, Chittenden Addition, according to the
plat thereof recorded in volume 31 of plats, page 75, records of Snohomish County
Washington hereby grants, conveys and quit claims unto the current and future owners of
said lots 3 and 4 herein, and to their heirs, successors and or assigns, a reciprocal
easement to use and occupy the following described lands and as depicted on the herein
attached exhibit "A', including but not limited to, the right to construct, reconstruct and
share equitably in the maintenance of said reciprocal ingress and egress easement for
driveway purposes with all appurtenances necessary including but not limited to the
access gate as it currently exists for the purposes herein conveyed.
That portion of lots 3 and 4, Chittenden Addition, according to the plat thereof
recorded in volume 31 of plats, page 75, records of Snohomish County Washington more
particularly described as follows:
Beginning at the northeast corner of said lot 3 and a point on the West right of
way of Olympic View Drive, thence South 00 40' 30" East along the East line of said lot
3 and said West right of way a distance of 16.00 feet;
Thence North 64 57' 37" West a distance of 37.51 feet to a point on the North
Line of said lot 3 and the South line of said lot 4;
Thence North 83 02' 08" East a distance of 34.00 feet to a point on the East line
of said lot 4 and a point on the West right of way;
Thence South 00 40' 30" East along the East line of said lot 4 and Said West right
of way a distance of 4.00 feet to the point of beginning.
All situate in the County of Snohomish State of Washington
Tax Parcels: 004251 000 003 00; 004251 000 004 00
This appurtenant easement shall run with the land as an appurtenance to said owner's
successors and or assigns of said lots herein described above. The doctrine of merger
shall not be applicable to extinguish or relinquish the easement rights created herein.
