Our interpolated elevations are based on actual field measurements, a discussion with the client as to pre - construction site conditions and over 2S years of experience within the surveying and construction industry and the standard building practices, site preparation and excavation required for similar projects. We are confident that although it is impossible to state the actual pre -construction grades, we have provided interpolated elevations designated "A" through "D" which are, in our opinion, a fair and accurate representation of pre -construction site conditions. Unfortunately, based on our field measurements, the highest point of the garage roofline is 2.38' above the maximum (see calculations). As the structure is substantially complete, I was wondering if the City would entertain a request for a variance? Based on my conversation with the clients, it is my understanding that the error was made without any knowledge of the existing code restrictions. Reduction of the structure to meet code would, in my opinion, not serve any esthetic benefit and ultimately would pose a financial burden. We would ask that the City consider the possibility of a variance to resolve the height violation. Additionally, it has been brought to my attention that there is still an outstanding issue with the location of the building to the North property line. Within other jurisdictions, we have resolved the setback issues by having the client and the adjoining neighbor execute an easement for the structure setbacks and maintenance thereof. Our client has spoken to the northern adjacent property owner who is open to helping them resolve the setback problem. We would ask that the City consider the possibly of an easement for resolution of the setback violation.
