I have been most concerned about and putting the most effort into the issue of a potential easement. 2 items are attached that are from a title search for the property. The short plat is from 1976 when parcels A & B were created on the west side of the street. This is the only information I have been able to locate detailing any easement relating to this property and it is to provide access to the subject parcel across the northerly neighboring parcel. Exhibit A is a more legible rendition of the easement information (but no map). There is what appears to be an typo in Exhibit A. After getting to the point 91.5’ north of the southeast corner of lot 15 the line turns west (this is OK and matches the map). The next direction should be North (not West as typed) both logically and to match the map. I assume the original document has the correct information but it is very difficult to read this copy. This easement provided access to the Andersen’s parcel at the northeast corner of their parcel from the north side. It appears that with the later construction of the homes across the street there must be a separate access easement providing ingress for the 3 homes across their parcels and not involving the Andersen’s. The distance measured from the edge of pavement to the back fence of the Andersen’s matches the 132’(.18) on the short plat and current site plan. The Andersen’s parcel has used the access created for the parcels to the east for many years and have a gravel parking strip on the east margin of their parcel. At some time along the way the neighbor to the north has landscaped a portion of the access easement. If you have other information about easement(s) please let me know. In the absence of other easement(s) I believe the porch as designed does not intrude on the setback at all and this resolves 2 of the review comments. As to lot coverage I will recalculate and break out the different elements but I have no concern about hitting the threshold. I expect to also reduce the overhang on the south side. Will it speed review to submit revised site plans prior to receiving comments from building?
