On behalf of the Planning Division, I have reviewed the above right-of-way permit application. During
review of the subject submittal, it was found that the following information, corrections, or clarifications
need to be addressed. Please respond to the following items, so that I can complete my review:
Tree Removal/Protection
1.: The Planning Division is reviewing the tree removal and landscaping
requirements in conjunction with the right-of-way permit.

Type III landscaping is required on the subject property along 216
for Type III landscaping pursuant to Edmonds Community Development Code (ECDC) 20.13.030 is
that trees be planted at intervals no greater than 30 feet on center. This requirement will still be met
with the proposed removal of the single pine tree in the location of the proposed driveway. The
driveway also cuts extremely close the two Douglas fir trees just west of the proposed driveway. If
these trees were removed, or suffered mortality because of the project, the 30 foot on center
requirement of Type III landscaping would no longer be met.
ECDC 18.45, Land Clearing and Tree Cutting Code, provides means for protecting all trees which are
to be retained in areas immediately subject to construction. These measures are spelled out in
ECDC 18.45.050.H and are as follows:
Where the drip line of a tree overlaps a construction line, this shall be indicated on the survey
and the following tree protection measures shall be employed:
1. The applicant may not fill, excavate, stack or store any equipment, or compact the earth in any
way within the area defined by the drip line of any tree to be retained.
2. The applicant shall erect and maintain rope barriers on the drip line or place bales of hay to
protect roots. In addition, the applicant shall provide supervision whenever equipment or trucks
are moving near trees.
3. If the grade level adjoining a retaining tree is to be raised or lowered, the applicant shall
construct a dry rock wall or rock well around the tree. The diameter of this wall or well must be
equal to the tree's drip line.
4. The applicant may not install ground level impervious surface material within the area defined
by the drip line of any tree to be retained.
5. The grade level around any tree to be retained may not be lowered within the greater of the
following areas: (1) the area defined by the drip line of the tree, or (2) an area around the tree
equal to one foot in diameter for each one inch of tree caliper.
6. The applicant may prune branches and roots, fertilize and water as horticulturally appropriate
for any trees and ground cover which are to be retained.
The planning division manager or his/her designee may approve the use of alternative tree
protection techniques if those techniques provide an equal or greater degree of protection than
the techniques listed above.
Given the proximity of the trees to the proposed driveway, it is apparent not all of these measures can
be carried out. However, the planning division may approve alternative tree protection techniques.
Please provide a tree protection plan demonstrating compliance with ECDC 18.45.050.H to help
ensure the survival of the two Douglas fir trees immediately west of the proposed driveway.
If these trees are removed or killed as a result of construction, replacement trees will be needed in
order to comply with the Type III Landscaping requirements.
