From: e Jeanie McConnell, Engineering Program Manager Proposal: Application for a right-of-way construction permit to remove a tree .located within the City right-of-way adjacen I to 98 l — 224"' St SW The applicant, Leif Flelleren of Leif Helleren Construction, has applied for a right-of-way construction permit to remove a tree located within the right-of-way adjacent to 9811 — 224'u, St SW, property owned by Einar Sorvik. In accordance with the policy on Procedures for Obtaining Permit Approval for Tree Removal or Trimming in City Right -of -Way, removal of trees located in City right-of- way will be approved only if one of the following conditions is met: The tree or trees present a safety or sight distance hazard; or The tree root system causes blockage of underground utility systems or damages other public improvements such as roadways, sidewalks, etc.; or The tree is damaged or diseased requiring its removal or trimming in the interests of the public health, safety and general welfare. The arborist report submitted by the applicant states "Restricted root area will come about as two adjacent properties have their yards graded down (already underway), In this process the free will lose roughly 50% of its roots on one side (buttress and absorbing). Once this has occurred the tree will become severely susceptible to wind - throw. To avoid this hazardous situation — regrading has been halted.". Owner: Einar Soivik 2. Applicant: Leif Helleren Construction 3. Contractor: L & G Tree Service 4. Location: In the right-of-way adjacent to 981.1 — 224`x' St SW, Edmonds III. APPLICATION MATERIALS: The right-of-way construction permit application (Attachment 1), which was submitted September 12, 2012, included an arborist evaluation prepared by Oliver Bailey (Attachment 2). The original application materials were found to be incomplete and a site plan from the arborist was requested and submitted on September 17, 2012 (Attachment 3). IV. APPLICABLE CODES & POLICIES: 1. Policy on Procedures for Obtaining Permit Approval for Tree Removal or Trimming in City Right -of Way 2. ECDC 18.45 (Land Clearing and Tree Cutting Code) 3. ECDC 18.85 (Street Trees) V. TECHNICAL REVIEW COMMITTEE: This application was sent to the Public Works Department, Parks Department and Planning Division for review. The Public Works Department indicated the subject tree did not fit the conditions of approval outlined by the policy. The tree does not present a safety or sight distance hazard and the tree root system is not presently causing blockage of underground utility systems or damaging other public road improvements. The Parks Department indicated the tree needs to be preserved and does not currently show signs of disease. Grading that has been completed in the vicinity of the tree prior to submittal of this application shall not continue further into the root zone. The Planning Division confirmed the tree is not located within an identified critical area. Photos of the subject tree and surrounding grading are included as Attachment 4 to this report. VI. CONCLUSION: The health of the subject tree could be threatened by continued grading of the area surrounding the tree, which would impact the root zone. The grading of this area is desired by the property owner, but is not mandatory to carry out development of the site in accordance with the approved building permit for the single family residence. Based on the above analysis of the project proposal, it has been determined that the tree does not meet the conditions of approval that would allow for removal of the tree. Leif of Leif Helleren Construction Tnc. contacted me to evaluate the potential effects of grading the yal,d down several feet at above address as well as the adjacent address where a new home is also'being built. , ` f l I made a site visit and prepared the attached report based on the condition of the tree once .regrading has been completed, Failure potential is much closer to (1) as the tree stands today �,iThich would give the tree a score of 8 on the'Form. A Photographic Guide to the Evaluation of Hazard Trees in Urban Areas. This tree's critical root radius (CRR) xca.ches fronn the root crown out to between 36' and 54' (l' - 1.5` X 36" DB14). It appears the seve5a.1 .Feet of re -grading would lower the grade enough to allow 0' of rooting area along one entire side of the t3.-ee. Extraction of the necessary roots to achieve grade would cause this tree to be easily wind -thrown into the high voltage power lines by Winter winds. Aside from this potential hazard, it is unlikely that this tree would survive losing 50% or morE of it's root mass. The current root volume would likely be heavier on tine construction side as the other half oftile rootball is under the street asphalt (anal beginning to crack and lift it). Based on my understanding of tree biology and the implications involved in such a re- grading operation as well as the near -future issue with street damage frons roots T recommend this tree be removed and replaced with more size appropriate trees to the new site co)3ditions.
