SUBJECT: REQUEST FOR ADDITIONAL INFORMATION FOR VARIANCE APPLICATION
FOR 190 SUNSET AVE.,FILENO. ENG20150564
Dear Mr. Anderson:
Staff has begun review of thevariance application you submitted on behalf of Astound Broadbandfor a
variance from Edmonds Community Development Code (ECDC) Chapter 18.05.010 Underground

Requirements. The variance is requested for the installation ofnew utility lines along Main St, 6Ave and
two stretches along Dayton St. to serve 190 Sunset Ave. S. (File No. ENG20150546). However, it was found
that the variance application is incomplete and submittedpartiallyas an appeal. Please address and submit the
following items at your earliest convenience:
1.The city’s understanding is that the permit ENG20150564 was withdrawn as a result of comments
provided to applicant,in this casean appeal is not the appropriate process for your request. Please
providean updated variance application with the removal of the appeallanguage for review by the
city.
2.The variance application shall contain the following:
a.Completed and signed right of way application (received)
b.Filing fee (received)
c.Site Plan (received)
d.Adjacent Property Owner’s list ( refer to handout #P2)
e.Written statement describing the specific requested variance and describing how the proposed
variance meets the criteria of ECDC Chapter 18.05.040 Variances.
3.For the purposes of chapter 18.05.040, the special circumstances necessary to justify a variance from
the undergrounding provisions of this chapter shall be limited to technological impracticability of any
required underground installation or to a finding that the cost of the underground installation is
excessive in light of the benefits derived and outweighs the benefits to be gained by the public. The
written statement shall include the following:
a.The special circumstances related to the utility undergrounding requirement that would
deprive Astound of rights and privileges permitted to other utility companies providing
service in the subject area.
b.Explain why approval of the variance would not be a grant of special privilege to the utility in
comparison with the limitations upon other utilities in the vicinity.

c.Explain how approval of the variance is not detrimental. Will your proposal for which you
seek a variance cause a loss of property value, scenic view or use of surrounding properties?
d.Explain how the proposed variance is the minimum variance needed to accommodate the
proposed project, or why there is no alternative other than a variance to complete the project.
4.Please note that review by the Engineering Division is pendingsubject to the parameters of Type II
development project permit application (see Chapter 20.01 ECDC)and additional comments
regarding the proposal may be provided upon review of your new submittal.
