ORDER EXTENDING STAFF AND
APPELLANT REPLY DEADLINE TO
OCTOBER 26, 2017
Whereas, a public hearing was held on the above -captioned preliminary short plat application
on October 12, 2017, and
Whereas, at the close of the hearing, the examiner left the record open through October 19,
2017 in order to provide an opportunity for responsive comments to Exhibits 2-6 admitted during
the hearing, and
Whereas, by emails dated October 13, 2017 and October 16, 2017, Michael Oneal submitted
additional emails addressing the same issues he raised in emails admitted as part of Exhibits 2-6,
and
Whereas, since Mr. Oneal's comments are within the scope of his comments within Exhibits
2-6, are personal to his property and were not shared by any other property owners on the southern
side of the project, his October 13, 2017 and October 16, 2017 comments will be admitted as
responsive to Exhibits 2-6 and staff and Applicant will have an opportunity to reply, and
Whereas, in the course of reviewing Mr. Oneal's comments submitted on October 13, 2017
and October 16, 2017, the City submitted a letter dated October 17, 2017 requesting a continuance
of the hearing because in reviewing Mr. Oneal's October 13 and 16, 2017 emails staff discovered
that the survey submitted by the Applicant incorrectly shows the northern boundary of the project
area as ten feet short of the recorded legal description for the project site, and
Whereas, correction of this ten foot discrepancy will only necessitate additional right of way
dedication from the applicant and will not otherwise change the location or nature of required and
proposed street improvements or otherwise change project design in any other way, and
Whereas, since correction of the ten foot discrepancy does not alter project impacts or
otherwise alter project design, a correction of the discrepancy in the Applicant's survey and an
associated dedication requirement from City staff will be considered within the scope of response
to the comments made by Mr. Oneal.

ORDER
1. Email comments from Mr. Oneal dated October 13, 2017 and October 16, 2017 are
admitted as responsive to Exhibits 2-6.
2. The reply deadline for staff and Applicant to comments made on Exhibits 2-6 (including
the October 13, 2017 and October 16, 2017 Oneal comments) is extended to October 26,
2017.
3. The reply comments made by staff and Applicant may include a survey correction to the
10 foot property line discrepancy identified in the whereas clauses of this Order in
addition to any associated changes in dedication requirements from City staff.
