Dear Applicant(s):
On October 30, 2006, you submitted an application for design review by the Architectural Design Board

(ADB) for the property at 301 4 Avenue North. The application was determined to be incomplete on
November 27, 2006, and the items required for a complete ADB submittal were never submitted.

This letter is to inform you that your application has pursuant to ECDC 20.90.010.D.4.
ECDC 20.90.010.D.4:
Applicants whose applications have been determined to be
incomplete shall submit the specified information within six months after the city
deposits a written statement detailing the reasons that the application is incomplete in the
U.S. mail, postage paid. A determination of incompleteness is a staff decision appealable
under Chapter 20.105 ECDC. If the specified information is not submitted within the six-
month period, than the application shall be rejected for incompleteness. Following the
initial notification of the applicant in writing that his or her application is incomplete, the
applicant shall receive one, and only one, six-month opportunity to correct the
application; no further notice shall be required and the six-month correction period shall
not be extended. After rejection for incompleteness, an application shall not be revived,
but the applicant may submit a new application under the provisions of this chapter.
We met last spring to discuss the new zoning regulations and the new design review process and how it
relates to your project. You submitted a site sketch showing the general layout of the site, but we did not
receive all of the required submittal items for a complete application and to get you to “Phase I” of the
public hearing (see below).
Originally, you had proposed an 8-unit condo project when the zoning was Multiple Residential (RM-
1.5). Now that the zoning has changed (to BD5) and now that the ADB process has changed, I’d like to
summarize what is required for a complete ADB application.

Several items are enclosed again, too, including the new Downtown Business code language (ECDC
16.43), the new design review process for the downtown district (ECDC 20.12), and the handout on the
District-Based Design Review Application Checklist.
Pursuant to ECDC 20.12.020.A.2, “Prior to scheduling Phase 1 of the public hearing, the applicant shall
submit information necessary to identify the scope and context of the proposed development, including
any site plans, diagrams, and/or elevations sufficient to summarize the character of the project, its site,
and neighboring property information. At a minimum, an applicant shall submit the following
information for consideration during Phase 1 of the public hearing:”
1.Vicinity Plan – Showing all significant physical structures and environmentally critical areas within a
200 foot radius of the site including, but not limited to, surrounding building outlines, streets,
driveways, sidewalks, bus stops, and land use. Aerial photographs may be used to develop this
information (ECDC 20.12.020.A.2.a).
2.Conceptual Site Plan(s) – Showing topography (minimum 2-foot intervals), general location of
building(s), areas devoted to parking, streets and access, existing open space and vegetation. All
concepts being considered for the property should be submitted to assist the ADB in defining all
pertinent issues applicable to the site (ECDC 20.12.020.A.2.b).
3.Conceptual Sketches or Elevations – Three-dimensional sketches, photo simulations, or elevations
that depict the volume of the proposed structure in relation to the surrounding buildings and
improvements (ECDC 20.12.020.A.2.c).
I would be happy to show you examples of the above items; there are a few projects to date that have
gone through this new design review process and we could examine their files and I could show you their
materials so you can get an idea of the requirements. The following items are standard land use
application submittal items and will need to be submitted as well:
Land Use Application – describing the new proposal.

5.Adjacent Property Owner List – new, current within 6 months.
6.Traffic Impact Analysis – revised to reflect your new proposal.
In closing, I would like to offer that we either (1) refund your sign posting fee ($150) because the sign
was never posted, or (2) we could apply it to a new application, whichever you prefer. Please contact me
when you’re able to proceed with a project at this site so I can walk you through the submittal
requirements.
