BURLEIGH SHORT PLAT FILE NO. PLN20150047
Dear Mr. Roland:
The Planning and Engineering Divisions have reviewed the 3rd draft recording documents (received on
November 17, 2016), and it was found that the following information, corrections, or clarifications will need to
be addressed before review can continue:
1. As requested in staff s November 3`d letter, it appears that a new easement from Olympic View Water Sewer
District was created for the Burleigh short plat after the title reports were issued since it does not show up in the
Burleigh title report. Please provided updated title reports for both short plats in order to document all existing
encumbrances on both properties. All existing easements must be indicated on the recording documents.
2. As requested in staffs November 3td letter, please obtain all required inspections associated with the demolition
permit that was obtained for the Burleigh site (BLD20161029). This demolition permit must be finaled before the
recording documents can be approved since the demolition of all existing structures was required as a condition of
preliminary approval.
3. As requested in staffs November 3`d letter, provide sufficient documentation that the individual who will be
signing the recording documents is authorized to sign the recording documents on behalf of Highpoint
Investments LLC.
4. As requested in staffs November 3`d letter, final inspections of the subdivision improvements and approved as-
builts will be required prior to final approval.
5. Note that Snohomish County requires that all of the taxes for the subject site be paid prior to recording for the
year in which the documents are recorded.
6. For both plats, please remove all instances of the word "pending". This process makes the short plats
final.
7. Refer to the specific comments below for corrections that need to be made to the final documents
Cheeks Short Plat Final Documents
Sheet 1
1. Under the "Restrictions" heading, the text stated as Item 43 should be a second paragraph of Item 42, not
a separate item.
2. Public Easement Provisions:

a. Correct "plot" to "plat"
b. It states that the easement is for "the purpose of serving this subdivision and other property". The
easement only serves Lots 1 through 4. Please remove "other property" from the easement language.
3. Stormwater Facility Maintenance Provisions:
a. Revise to state the facility is constructed on Lots 2, 3, & 4. Leave out the private easement for Lot 4
in this section, should be addressed in the private easement section.
b. Add language referencing the approve short plat on file at the city.
Sheet 2
1. Private Easement Provisions: Fire Access Easement (#2) The hammerhead is just part of the access
easement, there should not be a separate easement for fire. Please incorporate the hammerhead into the
language of the private access easement (#1) and relabel area on plan sheet. Be sure to revise the access
easement to include Lot 4.
2. Private Easement Provisions: Private Storm Drainage Utility Easement (43)
There should be two separate private storm drainage easements:
a. Addressing Lot 4 on the Cheeks W for the benefit of Lot 1 through 4
b. Addressing Lot4 on the Burleigh sp for the benefit of Lot 1 through 4 and the Burleigh sp
3. Private Maintenance Provision: Access Easement (41): Revise to state it crosses Lots 1 through Lot 4.
4. Private Maintenance Provision: Fire Access (#2): Remove. No specific fire access easement, all part of
the access easement.
5. Private Maintenance Provision: Add two stormwater maintenance provisions, one for each stormwater
drainage easement as described above.
6.Add a monument at the southwestern corner of the parent parcel.
Burlei2h Short Plat Final Documents
Sheet 1
1. Correct the file number under the "Declaration of Short Plat" heading to PLN20150047.
2. Remove Item #2 under the "Restrictions" heading. This is wording that was required to be included on
the Cheeks short plat, not the Burleigh short plat.
3. Public Easement Provisions: The revision does not fully meet the issues identified in the last comments
from the City.
a. The language references a 15 ft easement along the street and Lot 1. The plan sheet shows a 10 ft
easement on this plat. Please revise easement or plan sheet.
c. It states that the easement is for "the purpose of serving this subdivision and other property".. The
end of the easement states it is serving Lots 1 through 4. Please remove "other property" from the
easement language.
Sheet 2
1. Sewer and water easement on Cheeks property that serves the Burleigh properties has been removed
from the plan. Please add back.
2. Private Easement Provisions: #3 Storm drainage easement.
a. Cheeks short plat should only be granted access to Lot 4. Please revise.
3. Private Easement Provisions: #2 Fire access easement.

comment above. Please revise.
b. As above, the Cheeks short plat should only be granted access to Lot 4. Revise.
