Mark,
It has been determined that the City will allow you to provide a modified version of the prohibition
covenant as you have requested. Please incorporate the wording changes as shown in red below:
This covenant is being recorded in the real property records of Snohomish County,
Washington, in satisfaction of the requirements of RCW 64.55.010 through 64.55.090.
The undersigned grantor ("Owner") is the owner of the property described by the legal
description above (the "Property"), which is addressed in the records of the City of
Edmonds as:
20818 72nd Ave West, Edmonds, Wa.
The Owner irrevocably covenants and agrees:
Until termination of this covenant, no dwelling unit in or on the Property may be sold as
a condominium unit except for sales listed in RCW 64.34.400(2). This covenant
terminates on the earlier of either: (a) Compliance with the requirements of RCW
64.55.090, certified by the Owner of the Property in a recorded supplement hereto; or
(b) the fifth anniversary of the date of first occupancy of a dwelling unit as certified by
the Owner in a recorded supplement hereto; or
(c) the dwelling units become platted into a "unit lot line subdivision."
This covenant shall run with the land and shall bind the grantor and the grantor's heirs,
personal representatives, successors in interest and assigns.
It will be required that you provide us with the completed, notarized covenant prior to issuance of your
building permit, and we will perform our building code review accordingly (without building enclosure
documents.) Please coordinate with Kristin for the intake of this document and with the Planning
Division for the submittal of your subdivision application.

HI Mr. bjorback,
I am writing in regards to the condo sale prohibition covenant that I am proposing for the 72
West townhome project which is currently in review. The plan check # is BLDG208818-0811.
It is the intent of Hann Homes LLC, upon foundation completion ad spatial determination of lot
lines, to apply for a "zero lot line" or "unit lot line" subdivision. Hann Homes LLC would like
to start this process during, and reviewed concurrently, with the construction of the townhome
building. The goal is to record the subdivision just after issuance of final occupancy, so we may
sell the towhomes as induvidual properties.
Can you please review the attached condo sale prohibition covenant and let me know if it will
be acceptable to the City of Edmonds.
