Description of Violation: 1) Missing, broken, unreconstructed sidewalk abutting 155 — 3`1 Ave, South
Corrective Action Required: 1) Pay the additional sidewalk and parking disruption fees in the amount
of $4,953 by September 14, 2007; 2) Restore sidewalks and parking to full use by the public per City
letter dated September 7, 2007.
Correction is Required no later than: 1) Pay the additional sidewalk and parking disruption fees in
the amount of $4,953 by 4:00 pm September 14, 2007; 2) Begin restoration of sidewalks and parking
by September 17, 2007; 3) Complete restoration of sidewalks and parking to full use by the public by
September 28, 2007.
If correction is not made by the date and time specified in the Order, a Notice of
Civil Violation shall be issued. The Notice of Civil Violation shall assess fines of
$100.00 perday, or portion of a day, during which the violation continues.

RE: GreenburIj Building, Parking and Sidewalk Disruptions
Dear Mr. Greenburg:

On February 1, 2006, a total of $8,155 was paid to the City of Edmonds to cover sidewalk and parking
disruptions associated with the Greenburg Building's construction. Those disruptions were not expected
to last longer than one year.
The sidewalk and parking disruption fees paid for your project covered disruptions through February 1,
2007. To date, parking and pedestrian movement ability remains unavailable. As of September 1, 2007
additional parking and sidewalk disruption fees in the amount of $4,953 are due to the City to cover
parking and sidewalk disruptions through September 1, 2007. Please remit this amount by September 14,
2007. Additional disruption fees will be assessed until sidewalks and parking are restored to full public
use.
It was never the City's intention to grant such sidewalk and parking disruptions on an open-ended basis,
whether paid for or not. Such a situation as this is becoming a public access and safety issue which is both
unacceptable and a code violation. Several complaints have been received by the City concerning this.
Therefore you are directed to begin construction of sidewalks and curb no later than September 17, 2007,
and complete restoration of the sidewalks and parking along the frontage of your property to full use by
the public no later than September 28, 2007. We realize that portions of the sidewalk may need to be
subsequently removed for future construction activities, therefore we will permit the sidewalks to be
constructed of asphalt in the interim until permanent replacements can be installed. Please note that ADA
slope and truncated dome requirements will still need to be met at the intersection. If you have any

Again, please begin the above -noted corrections by September 17, 2007, and complete them no later than
September 28, 2007. Please refer to the enclosed Order to Correct Violation. We will assist and monitor
your prowess to that end. Call our Engineering Inspection line (425-771-0220, Ext. 1326) to schedule the
requirea inspections.
