Glenn Simpson, a certified arborist, has recommended the removal of three (3) trees, one Madrones (Arbutus) and two Cherry (Prunus avium) trees. The property at 126 Highlands Drive does not fall into exemptions from tree cutting permitting requirements of ECDC 18.45.030, the subject trees are located in a critical area and/or critical area buffer. Slopes on the property to exceed 40% according to the City's LiDAR information. These areas are consider potential landslide pursuant to ECDC 23.80. Generally the removal of trees, or any vegetation, within a critical area or critical area buffer is not an allowed activity, unless, pursuant to ECDC 23.40.220.C.8, it involves the removal of invasive species or hazard trees. ISA Tree Risk Assessment forms, prepared by Glenn Simpson (PN-6464A) were submitted with the request to remove three (3) dead trees that were determined to by a high risk. Mr. Simpson recommended the trees be removed. Due to the high risk for failure of the trees as stated in the assessment forms and shown in photos, they are candidates for removal. Pursuant to ECDC 23.40.220.C.8.b.iv each hazard tree removed within a critical area or critical area buffer must be replaced with new trees at a ratio of two to one. Mr. Simpson attached a cover letter nothing that six trees will be planted to replace the three that are proposed for removal, and those trees will consist of Mountain Hemlocks (Tsuga mertensiana), Dogwoods (Cornus nuttallii), and Vine maples (Acer circinatum). An exemption for the tree cutting is granted with the following conditions: 1. This approval only pertains to the three trees evaluated in the attached arborist report. A minimum of six (6) replacement trees must be planted in the general vicinity noted on the attached site plan. The replacement trees must be native and indigenous in accordance with ECDC 23.40.220.C.8.b.iv. Evergreen replacement trees must be at least six feet in height as measured from the top of the root ball and deciduous trees must be a minimum of one — two inches diameter at breast height. The replacement trees must be planted within one year of tree the tree cutting activity. Mountain Hemlocks (Tsuga mertensiana), Dogwoods (Corpus nuttallii), and Vine maples (Ater circinatum) have been proposed as replacement trees. Either of these tree species would be appropriate. Alternative species must be approved by the City of Edmonds. 3. Stumps of the tree cut must be left in place to provide slope stability and prevent erosion. 4. Replacement trees must be planted within one year of removal of the hazard trees. Please notify the City once the replacement trees have been replanted for an inspection. 5. Trees shall be fell onto private property. 6. Vehicles and equipment shall be located on private property. Should it be necessary to use the City right-of-way to perform any of this work, then the contractor shall apply for and obtain a right-of-way construction permit in advance of starting work. A traffic control plan will be required as part of the right-of-way permit application. 7. Contractor/owner is responsible for keeping all debris on site and preventing any silt laden runoff from leaving the site and/or entering the city storm system. Arborist Findings: I found that all above mentioned trees are dead. Recommendations: My recommendations is too remove the Madrones and the two Cherry trees, all these trees will fail and cause damage to the Emme's property. The Emme's agree to plant six new trees following the 2:1 ratio. New will be Mountain Hemlocks, Dogwoods and Vine Maples to be planted in the next years time. All additional work requested by customer above and beyond what is written in the contract will constitute additional charges. Permit cost, acquisition, and municipal code compliance is customer responsibility unless noted above. Should landscape get damaged, both parties agree that Ever -Green will reseed any damaged turf areas and replace any damaged plants and trees with similar species in common nursery available size. Ever-Greeri's liability is limited to onsite work. Customer acknowledges that final decision on work to be performed was made by customer, and if any tree/s are a healthy living tree, that Ever -Green has discussed alternatives to tree removals, such as trimming. Three-year cabling warranty is limited to Repair or Replacement of cabling system in the event of product failure, or defective installation. This warranty does not cover excessive winds or other Acts of God. For warranty to be valid, client must contact Ever -Green annually to inspect cabling system. Additionally, tree may need frequent pruning to keep stress on cabling system within reason. Additional pruning to be at customer expense.
