Slopes on the subject property are approximately 30% according to the City's LiDAR information. These slopes classify the site as containing erosion hazards which are a type of critical area pursuant to Edmonds Community Development Code (ECDC) 23.40 and 23.90. ECDC 18.45.030.A provides exemptions from tree cutting permits, except on property with environmentally sensitive areas (i.e. critical areas) or where slopes greater than 25% exist. Since the subject property contains a critical area with slopes greater than 25%, it does not fit into the exemptions listed in ECDC 18.45.030. However, the removal of trees, or any vegetation, within a critical area or critical area buffer may be allowed under ECDC 23.40.220.C.8, if it involves the removal of invasive species or hazard trees. An arborist report and tree risk assessment form prepared by Steve Cushing documents has been submitted that documents the seven trees in question pose a high risk to the structure on the property as well as neighboring residences. Since the trees were classified as high risk, the removal of these trees fall under the allowed activity provision of ECDC 23.40.220.C.8.b. Hazardous trees that are removed under ECDC 23.40.220.C.8.b are required to be replaced at a ratio of 2:1 with trees that are native and indigenous to the area. A letter from Ray Walker of Walker Landscape and Maintenance was submitted suggesting that the seven trees be replaced with eight big leaf maples and 6 western red cedar. Staff called Tim Price of Platinum Homes, with concerns about potential future problems with the planting eight big leaf maples trees. Big leaf maples can grow to 75 feet in height with a spread of 50 feet, so staff was concerns about growing space for eight big leaf maples on the site. In consultation with Tim Price, it was determined that instead of the eight big leaf maples, vine maples would be planted instead which are a small tree more appropriate for the site. An exemption for the tree cutting is granted with the following conditions: 1. This approval is only for the removal of the seven hazard trees identified in the attached arborist report dated June 29, 2017 prepared by Steve Cushing. 2. Fourteen replacement trees are required to replace the seven trees being removed. The proposal is to plant eight vine maples and six western red cedar trees. The replacement trees may be planted anywhere on the property to provide flexibility and minimize need for future problems as the trees grow. Pursuant to ECDC 23.40.220.C.8.b.iv, replacement trees are to be one to two inches in diameter at breast height (dbh) for deciduous trees and a minimum of six feet in height for evergreen trees as measured from the top of the root ball. Vine maples are a multistemmed tree where mature trees have stems one to two inches in diameter. ECDC 20.13 (Landscaping Requirements) recognizes this specific growth patern and establishes a minimum state of eight feet in height for vine maples and other multistemmed trees (ECDC 20.13.015.6). If vine maples with a diameter of at least one inch cannot be found, smaller diameter vine maples a minimum of eight feet in height may be used. If the identified replacement trees cannot be found in the required size, substitute replacement trees that are native and indigenous to the area may be approved by the Planning Division.
