Dear Applicant:
I have re -reviewed the above building permit application for the Planning Division and it was found that
the following information, corrections, or clarifications will need to be addressed before review can
continue:
I. Concrete Auto Court: This area, like any uncovered patio, may project into the south side setback
no more than 3.33 feet (1/3 of the required 10 -foot setback). The site plan shows this area
encroaching more than 3.33 feet into the setback. Please revise the site plan to meet this code
requirement.
I'm sorry -- the original correction was dijfcult for me to explain in writing... Basically, the
minimum setback is 10 feet, but this proposed auto court may project up to one third into the setback
pursuant to ECDC 1620.040.0 (see quote below). This means that it cannot be located closer than
6.7 feetfrom the property line. Please redline or revise the site plan to show how the auto court is at
least 6.7feetfrom the property line.
ECDC § 16.20.040.0 Uncovered and unenclosed porches, steps, patios, and decks may
project into a required setback not more than one-third of the required setback, or four
feet, whichever is less; provided, that they are no more than 30 inches above ground level
at any point.

(affected sheets only) with a written response to each of the above items. Please make all submittals to
the Development Services Permit Coordinator Monday through Friday, 9am to noon or Ipm to 4pm. If
