After discussing your question with Deb and Dave, we can setup an account to hold Mr. Leiser's
$15,000 deposit and draw from the account to pay related bills from.
We did have some follow-up questions that we thought it may be prudent to work into this fairly
unusual request:
1) Will there be some sort of inspection of the WSDOT property to make sure the City will not
take on additional unseen liabilities? And how will these be addressed/remedied in a
contract?
2) Will the contract address who will pay all the additional costs, including redeveloping the
cul-de-sac, staff time working on this project, etc?

Hello Scott,
I am working with Shaun Leiser, a property -owner, who is interested in applying for a street vacation
—which would require a land acquisition from WSDOT.
Mr. Leiser owns three properties adjacent to the terminus of 84th Ave W in south Edmonds. In order
to apply for the street vacation, the existing cul-de-sac would have to be moved north to land
currently owned by WSDOT. We have confirmed with WSDOT that the land itself could be
transferred to the City for the purposes of a new cul-de-sac at no cost; however, the City would have
to pay for WSDOT costs including, but are not limited to:
• reviewing and commenting on the request;
• attending meetings related to the request;
• site inspections of the property being requested;
• revising right of way plans;
• any appraisal requirements;
• creating a legal description, and;
• preparing conveyance or leasing documents for eventual signing and/or recording.
WSDOT estimates the associated costs to be around $15,000. Money is not held by WSDOT. The
City would receive monthly invoices for the associated costs. Mr. Leiser is willing to provide funds to
cover the total cost, but the question is whether setting up an account to hold Mr. Leiser's money
and handle invoicing from WSDOT is within the City's capabilities or not. Please advise.
Attached you will find a map that illustrates the proposal and the JA application from WSDOT. Please
let me know if you have clarifying questions. Staff is meeting with Mr. Leiser on Jan. 17th to discuss
the proposal. A response by then is appreciated.
