JOINT MAINTENANCE AND EASEMENT AGREEMENT
For and in consideration of the mutual benefits derived herein and other goods and
valuable consideration, receipt whereof is hereby acknowledged, and Arne L and Raquel M
Gaenz as the fee simple owner of Parcel 1 below and Kelli Homes LLC as the fee simple
owner of Parcel 2 of below described property:
Parcel 1, located at 1020 BELL ST, EDMONDS, WA 98020 with a legal description of
CITY OF EDMONDS BLK 040 D-00 - ALL LOTS 6 & 7 and Snohomish County Washington

Parcel 2, located at 1024 BELL ST, EDMONDS WA 98020 with a legal description of
CITY OF EDMONDS BLK 040 D-00 - LOTS 8 & 9 and Snohomish County Washington Tax
Parcel ID: 00434204000800
Said owners/grantors do hereby grant, convey, establish, and create an easement for the
placement, maintenance and monitoring, construction, reconstruction, repair and upkeep of the
following; storm drain retention vault, storm drain piping, storm drain field, water lines, side
sewer, and low voltage utilities. The easement provides the ability for cutting and removal of
brush, trees and other obstructions which interfere with the use of said easement, together with
the rights of ingress, egress and regress, over under along and across the following described
portions of the above referenced property:
The North 12 feet of Parcel 1 running parallel to Bell Street, the 5' running along the East
border of Parcel 1, and 15' running along the South border of Parcel 1.
The North 12 feet of Parcel 2 running parallel to Bell St and 5' running along the West
border of Parcel 2.
Said easement is appurtenant to Parcels 1 and 2 and is hereby conveyed to Kelh Homes
LLC, being the present owner of said land and to their heirs, successors, and assigns.
All situated in the County of Snohomish State of Washington.
MAINTENANCE of said properties herein shall be equally liable and responsible for all
maintenance and repair of the storm drain system. No single expense for maintenance or repair
of the storm drain system in excess of ONE HUNDERED DOLLARS shall be incurred by either
party without the knowledge and consent of the other, except under emergency circumstances.
MAINTENANCE of said properties side sewer shall be the responsibility of Parcel 1
from Parcel 1 to the location where the Parcel 1 and Parcel 2 side sewers join. The maintenance
for Parcel 2 shall be from the connection point of the home located on Parcel 2 to the location
where the Parcel 1 and Parcel 2 side sewers join. The maintenance shall be shared from where
Parcel 1 and Parcel 2 side sewers join, to the North property line of Parcel 2.
Should any work be conducted within the bounds of the easement, of the service lines
on either property and have to be dug up, repaired or replaced, the surface of the ground shall
be restored to its original condition, as near as may be, by the party causing the repair work to
be done.
Said joint maintenance agreement and easement is a covenant to run with the land herein
described for the benefit of said grantees herein, their successor's and or assigns until such time
that said instrument is relinquished of record.
