Box 74 Edmonds, WA. 98020 Case: # COD2011-0239 Subject Property: 10307 238`h St. S.W., Edmonds, WA. 98020 Dear Property Manager, The City has received several complaints/inquiries regarding the hanging sign in front of Klahaya on 238`h St. SW. The concerns are that the short height of the sign has established an impediment to pedestrians and that the base of the sign appears to have decayed, creating a potentially unsafe condition for pedestrians and vehicles in the public right-of- way. Research of existing land -use records at this location established that the sign is located in the City right-of-way. Snohomish County could not locate a permit for the sign. It is not clear when the current sign was constructed. Given the current decayed condition of the sign, the City is presuming that you already have short term plans to remove, modify or replace it. Because the sign codes, permit requirements and right-of-way requirements have changed over the decades before and after the annexation date (1995), the City requests that you review any plans with the Planning Division prior to implementation. The current sign code for permits reads as follows: 20.60.010 Permit required. A. Except as provided in this chapter, no permanent sign may be constructed, installed, posted, displayed or modified without first obtaining a sign permit approving the proposed sign 's size, design, location, and display as provided for in this chapter. B. Design approval is not required for the posting ofpermanent signs in residential zones; provided, that the restrictions and standards ofthis chapter are met. Ifadditional signage is requested for conditional or nonconforming uses in residential zones, the property owner shall apply for design review. Design review is not required for any sign which does not require a building permit. C. A sign modification shall include, but is not limited to, relocations, modifications to size, design, height or color scheme, or the replacement of 25 percent or more of the structural material in the sign area. Normal and ordinary maintenance and repair, and changes to the graphics, symbols, or copy of a sign, without affecting the size, structural design, height, or color scheme, shall not constitute modifications for purposes of this section. [Ord. 3514 § 2, 2004; Ord. 3461 § 2, 2003]. It would be appreciated if you could contact me at your earliest convenience by November 15, 2011 to advise your short term plans regarding this sign.
