It is hereby determined that pursuant to Chapter 17.40 of the Edmonds Community Development Code the
property identified above contains a nonconforming (check only one of the following):

Description of legal nonconforming building (describe in detail):
The existing single-family residence on the
above-described property was legally constructed under City of Edmonds building permit number BLD-1961-0044.
A building permit was applied for (BLD-2006-0734) in order to construct a small entry vestibule and new master
bedroom/dining room addition – all of which meet the minimum setback, height, and lot coverage requirements
under today’s code. It appears that there is a small triangular portion of the existing structure on both the north and
south sides of the building that do not meet the current required 7.5-foot side building setback under the Single-
Family Residential (RS-8) development standards.
This determination was made based on the following information and documentation:
The original building
permit for the single-family house (BLD-1961-0044) was reviewed – it is one page on microfiche and is attached.
The building permit application for the proposed new addition (BLD-2006-0734), which depicts the existing
building footprint extending slightly into the setback area on the north and south sides, is also attached. The
Snohomish County Assessor’s records were researched, and their structure data for this site corresponds with the
original building permit data.

This determination is made with the understanding that the status of the parcel may be altered by
amendments to the Edmonds Community Development Code (ECDC) adopted subsequent to the issuance of
the determination and provided that the City shall not be liable for damages for its action to amend the
ECDC affecting this determination. This determination shall be null and void if any activity, action, or
omission as listed in ECDC Chapter 17.40 occurs which would terminate the nonconforming status. This
includes, but is not limited to, alteration to the nonconforming use, building, lot or sign not in accordance
with the requirements of the Edmonds Community Development Code, including required approvals and
permits.
