An inspection was made on June 25, 2009 and two commercial vehicles remained. It also appears that
employees continue to come to the property, adjacent drive or church parking lot.
The City has already issued an Order to Correct Violation to cease these activities that don't meet the
criteria of the Administrative Home Occupation Permit. Therefore, the next step in the enforcement
process is to issue a Notice of Civil Violation which includes a fine of $100.00 per day.
Also, as previously noted, the current Home Occupation permit can be revoked if the requirements of the
Administrative Home Occupation Permit are violated. This would mean that M business would need to
cease and no commercial vehicles could come to the site. A copy of this file is being forwarded to the
Planning Manager to consider that option.
This letter is the fourth time that the City has outlined the requirements for a business to be conducted in a
residential zone. Accordingly, the City is obligated to issue a Notice of Violation and possibly revoke the
current Home Occupation permit for another violation of the home occupation requirements. Inspections
will be increased and may also be conducted on evenings and weekends.
Until a Conditional Use Permit is acquired allowing employees and multiple commercial vehicles, the
following corrective actions are required immediately and permanently:
• Only one commercial vehicle is allowed at or to the site at all times. This vehicle must also be
under 10,000 pounds gross weight.
• No employees can visit the site for any amount of time. Parking adjacent or in a church parking
lot, or using the adjacent properties does not circumvent this requirement. It only imposes the
requirement for the church to obtain a business license, You can propose that business
development as part of a Conditional Use Home Occupation application should you choose to
apply.
