Dear Richard,
Thank you for submitting the updated landscaping plan and cost estimate on July 12, 2011. I have
reviewed the plan and found it to be in keeping with the Architectural Design Board's recommendations
at their June 15, 2011 meeting. However, in accordance with Condition #2 of PLN -2009-0047, a
performance bond is also required for the proposed landscaping. Enclosed is a performance bond letter
that you can take to your bank and create a deposit for the amount of the proposed work you have
identified in the cost estimate - $390 in this case.
Because work will be occurring within the City right-of-way on 202nd Place, a permit from the
Engineering Division is required. Please contact Jennifer Lambert for more information on obtaining
that permit.
It is understood that the three replacement trees required by the ADB will not be installed until the fall
2011 planting season. Once you choose and install the trees, please let me know so the landscaping plan
can be updated with the exact species selected. At that time, I will also reduce the amount of the bond to
15% ($58.50) and hold that as the maintenance bond for two years. At the end of the two years (fall
2013), I will need to do a final inspection to determine whether the plantings are healthy. If the trees
need to be replaced or maintained at that time, I will let you know and either you can perform that work
or I can call the remaining bond monies to see that the work is completed. If the trees are healthy at the
time of final inspection, the remaining maintenance bond monies will be returned to you.
Only when I have received the completed bond form and you have obtained a right-of-way permit from
the Engineering Division may the three firs may be removed in accordance with PLN -2009-0047.
