Dear Mr. McDougall: GARY HAAKENSON MAYOR The City of Edmonds Planning Division has reviewed your request received on .lune 29, 2006, for an exemption from the requirement to obtain a Shoreline Substantial Development Permit (SDP). The purpose of the project is to allow a modification to an existing residential structure located on the Edmonds shoreline. The project is described in correspondence from the applicant, together with photographs showing existing conditions as well as the nature of the addition. The project is essentially to enclose a portion of an existing porch/deck, similar to other unit(s) in the building. Upon review of the project, the City has concluded that the proposed work is exempt from the need to obtain a Shoreline Substantial Development Permit. In reaching this conclusion, we reviewed pertinent sections of the Washington Administrative Code (WAC) and Revised Code of Washington that potentially relate to this type of project and have determined that the project is exempt under RCW 90.58.030(3)(e), which defines a "substantial development" as: (e) "Substantial development" shall mean any development of which the total cost or fair market value exceeds five thousand dollars,. or any development which materially interferes with the normal public use of the water or shorelines of the state. This project is consistent with the City of Edmonds Shoreline Master Program (Chapter 23.10 ECDC)- The project is completely within the footprint of an existing multi family building, which is considered to be a "nonconforming development" under the City's Master Program. As Incorporated August 11, 1890 SM -2006-90 Page 2 a nonconforming development, it may be continued provided "that it is not enlarged, intensified, increased, or altered in any way which increases its nonconformity." [ECDC 23.10.220.13; emphasis added.] In this case, because the project is proposed entirely within the existing structure, and no new residential unit is being added, the project does not constitute an enlargement of the building or an intensification of the existing use. So long as the project conforms with the description provided by the applicant, the project will be determined to be exempt. Should any of the assumptions and conditions listed above be proposed to be modified during the project, this office must be notified immediately so that a determination can be made as to whether the Shoreline exemption is still valid.
