Please respond to the following items in order to provide a complete application for processing: ECDC 20.75.180.A requires an affidavit with supporting documentation to demonstrate the criteria in ECDC 20.75.180.A. I — A.5 are met. No affidavit was submitted with the application and additional documentation is needed determine whether criterion A.1 and A.4 are met. Please submit the following in support of the innocent purchaser application: a. A signed notarized statement detailing how each criteria in ECDC 20.75.180.A.1 —A.5 are met. b. In order to document compliance with ECDC 20.75.180.A.1, please respond to the following: i. It is noted that the legal description on the Notice of Trustee's Sale (Auditors File Number 201505270926) and the Deed of Trust referenced on the Investors Choice Property Detail sheet (AFN 200505260729) differs from the legal description on the Trustee's Deed Upon Sale (AFN 201602010295), Quit Claim Deed (AFN 2016062010296), and Deed of Trust (AFN 201602010297). Please explain why the legal descriptions vary between the property that was noticed for sale and the deeds recorded upon sale. ii. Please provide copies of all documentation on the subject property that you had prior to the auction sale being finalized. c. In order to document compliance with ECDC 20.75.180.A.4, please provide a copy a deed or record of survey showing the subject parcel as a separate lot at the time of purchase. In addition to the completeness items above, additional information is needed to evaluate the application for innocent purchaser. Please respond to the following: 2. Please provide a title report for the subject property. 3. The subject property does not have direct access to 2401h Street SW. Please provide an easement or other documentation that the subject property has legal access to 2401h Street SW. Finally, please note that in accordance with ECDC 20.75.180.13, if it is determined that the criteria for innocent purchaser has been, the innocent purchaser status approval may be subject to conditions of approval requiring the applicant to make improvements to the property that would likely have been required by the city had the property been properly subdivided. If it is determined that you meet the innocent purchaser status criteria, it is likely the some improvements will be required. In accordance with ECDC 20.02.003.D.1, the above requested information must be submitted within 90 days (September 12, 2016) or the application will lapse for lack of information to complete the review.
