A. INTRODUCTION st The applicant is proposing to remove a common property line between 7512 221 Place SW (00593900000300) and 22020 Highway 99 (2704900303900). Both parcels are owned by st Nelson Motor and are zoned CG-2. The parcel at 7512 221 Place SW is currently vacant but is proposed to be redeveloped into a parking lot for the Lynnwood Honda facility at 22020 Highway 99. B. ANALYSIS OF DESIGN: 1. Number of Lots Involved: Prior to Lot Line Combination - 2; Post Combination - 1 2. Lot Area: NA 3. Topographical Consideration: There is no particular topographical consideration influencing the lot line combination. 4. Flag Lot Determination: The subject parcels are not considered flag lots. 5. Corner Lot Determination: The combined parcel will not be considered a corner lot. 6. Comprehensive Plan: The proposal appears to meet the intent of the Comprehensive Plan. 7. Zoning Ordinance: According to Edmonds Community Development Code (ECDC) Section 20.75.055.A, a lot combination is the combination of two or more legal, illegal, or nonconforming lots into one or more lots, all of which comply with the provisions of this code in effect at the time of said combination. The current proposal meets the requirements of the zoning code. Both lots currently conform to the underlying zoning and will do so upon combination into one lot. 8.Access: Current access of the individual parcels will not change with the proposed lot combination. C. ENVIRONMENTAL ASSESSMENT: 1. SEPA Determination: A DNS was issued pursuant to a demolition permit for the st previous structure located at 7512 221 Place (BLD-2007-0797. No appeals were received. LL-2007-93 Page 2 of 3 2. Shoreline Master Program: Exempt from Shoreline Master Program permits. 3. Critical Area Determination: A critical areas checklist (CRA-2007-0108) was st completed for the redevelopment of 7512 221 Place as part of the demolition permit process. A study was required due to the presence of a possible erosion hazard on the site. Study requirements will be addressed during building permit review for the parking lot. A waiver from critical area report requirements was issued for 22020 Highway 99 (CRA-2004-0043). D. REQUIRED IMPROVEMENTS AND DEDICATIONS: The Engineering Division and the Fire and Public Works Departments have reviewed the application and are not requiring any improvements or dedications. E. DECISION: Approved with the following conditions: 1.Include the lot combination file number LL-2007-0093 on the documents to be recorded. 2.Make sure all documents to be recorded meet the Snohomish County Auditor’s requirements for recording, including all signatures in black ink. Application 3.Proposed Lot Line Combination Map I have determined that the application is complete and have reviewed the application for lot line combination pursuant to Chapters 20.75 and 20.95 of the Edmonds Community Development Code. _____ December 13, 2007_____ Michael Clugston, Planning Division Date -------------------------------------------------------------------------------------------------------------------------- RECONSIDERATION OF DECISION A request for reconsideration or clarification of this decision may be made by filing a letter and fee with the Planning Department within ten (10) working days of the date of decision. THE RIGHT TO APPEAL This decision may be appealed to the Hearing Examiner. In this case, a written letter and other items needed to appeal must be submitted to the Planning Division within fourteen (14) calendar days of the date of decision. Please contact the Planning Division for information. Note that per ECDC 20.105.010.A.2, appeals of lot line adjustments are limited to appeals by the applicant only of a denial of a requested lot line adjustment application. LL-2007-93 Page 3 of 3 TIME LIMITS FOR RECONSIDERATION AND APPEALS The time limits for reconsiderations and appeals run concurrently. If a request for reconsideration is filed before the time limit for filing an appeal has expired, the time “clock” for filing an appeal is stopped until a decision on the reconsideration request is completed. Once the staff has issued his/her decision on the reconsideration request, the time clock for filing an appeal continues from the point it was stopped. For example, if a request is filed on day 5 of the appeal period, an individual would have 9 more days in which to file an appeal after the staff issues their decision on the reconsideration request.
