Before I can continue with my review, however, the following information needs to be clarified: 1)Fruitdale Creek. A portion of Fruitdale Creek runs through Parcel B (Marriott) and continues into the Native Growth Protection Area (Tract 101) adjacent to Parcel A (Hustler) on the west. Please indicate the position of the creek on the plat as it occurs on Parcel B. Also, please show the position of the footbridge that traverses the creek on the Marriott parcel. 2)Shed. The shed located to the rear of the Marriott parcel is an existing nonconforming structure. At 4.8 feet from the northern property line, it does not meet the minimum 10-foot side setback requirement in the RS-12 zone. As proposed, the adjustment further increases nonconformity of the shed by establishing a 6.6-foot setback from the new western lot line. The new line would be considered to have side setbacks in relation to the Hustler property which would require 10 feet between the property line and the shed. Ownership of the shed is also unclear. It appears that the Marriott’s currently own the shed and gain access to it via the footbridge over Fruitdale Creek. The lot line adjustment proposal indicates that the shed would become the Hustler’s, if approved. Would the Marriott’s have access to the shed in the future? If so, an easement would need to be established to formalize the use. In the end, the shed must meet the setback requirements of the zone in order to continue. As a result, the proposed lot lines must be altered to allow for sufficient setback distances or the shed must be moved or removed. 3)Zoning. Please add the current zoning designation of the parcels to the face of the plat: RS-12, in this case. If you have any questions, please contact me at 425-771-0220.
