Location: 8415 218`h St. S.W., Edmonds, WA. 98026
Dear Mr. Lovgren,
DAVE EARLING
MAYOR
The City received a complaint regarding your newly constructed fence. The fence appears to be over three
feet in height within 1.0 feet of the street right-of-way which does trigger a building permit requirement.
The purpose of the permit requirement is generally to confirm height and ensure that sight distance
requirements are maintained.
Please find enclosed the City of Edmonds handout on fences. The following extracted code sections in the
Edmonds Community Development Code (ECDC) would apply to the fence (bold added):
ECDC 17.30.000 General.
A. A fence permit shall be required for any fence over three feet in height which is also within 10 feet
of any street right-of-way or access easement or within 30 feet of any corner. Height shall be measured
from the top of the fence to the lowest original grade.
B. A fence permit shall be required for any fence within a critical area or its buffer.
C. Unless a variance is first obtained, no fence shall be more than six feet in height as measured from the
top of the fence to the lowest original grade.
Corrective action required:
® Please make a complete application for a fence permit at your earliest convenience by January 31,
2012 (please note that even with a permit, a height or location modification may be necessary) or;
® Remove any portion of the fence above three feet that is within 10 feet of the street right-of-way.
If you choose this option, you will want to consult with the engineering division regarding the
right-of-way location.
Thank you in advance for your cooperation and assistance.
Sincerely,
Mike Thies
