Subject: Tree Cutting at 15610 and 15620 72nd Avenue West
Mr. Halverson,
On March 24, 2015 it was reported that there was some tree cutting on the slope in the area of
the above reference property. Upon inspection of the property, it was noted that several trees had
been topped on the slope on the west side of this property. As you are well aware given the
permitting activity on the subject property of the last couple of years, this site is located in the
North Edmonds Earth Subsidence Landslide Hazard. The slopes where the tree cutting occurred
are in excess 40% and this together with the property being in the Earth Subsidence Landslide
Hazard Area classifies the site as a critical area pursuant to ECDC 23.40 and 23.90. The
geotechnical report submitted for development in the area noted there should be no disturbance
within 25 feet of the top of the slope. Additionally, this area was identified as a native growth
protection area on the preliminary short plat under PLN20140015. Condition of approval
number 4 for the short plat noted:
Any tree cutting on the site must be consistent with the requirements of ECDC 18.45 and the
30% native vegetation requirements of ECDC 23.90.040.C. A tree cutting plan shall be
submitted and approved with the civil plans for removal of trees impacted by the subdivision
improvements. Any tree cutting proposed on the site that is not a hazardous situation and/or
not necessary as part of the subdivision improvements shall be reviewed at the time of
building permit application review or through the appropriate land use permit application and
review process. All trees that are to be retained during the development process must be
protected according to the performance standards found in ECDC 18.45.050.H. If during
construction it is realized that certain trees that were planned to be retained will be damaged
due to the construction activities, replacement may be required per ECDC 18.45.050.F.
The cutting activity on the slope is a violation of the City's tree cutting regulations under ECDC
18.45, the critical area regulations under ECDC 23.40 and ECDC 23.90 and a violation of the
conditions of approval of the short plat under file number PLN20140015. All tree cutting on the
subject: property must cease.
In order to assess the activity to inform any required mitigation and enforcement actions, please
provide the following information:
1. Please provide a -report from a certified arborist detailing the extent of the cutting activity.
The report must include a site plan identifying the location of all cutting activity, the
species of the trees and other vegetation that was cut, the diameter of the vegetation that
was cut, an assessment of the health of the trees that were trimmed and likelihood of
survivability.
2. Please provide a geotechnical report assessing the impact of the tree cutting on the slope.
