SUBJECT: Request for Clarification of Hearing Examiner Decision
Madrona K-8 School Replacement - File Nos. PLN20160027 — PLN20160029
Dear Mr. Olbrechts,
Thank you for your October 27 decision regarding the Madrona K-8 School Replacement
project at 9300 236th Street SW (File Nos. PLN20160027, PLN20160028 and PLN20160029).
Pursuant to ECDC 20.06.010, parties of record may file a request for reconsideration of the
Hearing Examiner's decision within 10 calendar days of the Hearing Examiner's written
decision. This is not a request for reconsideration, per se, but rather for clarification on some
of the condition language.
The condition language found in the staff report to the Examiner dated October 5, 2016 was
adopted verbatim in the October 27 final decision but there are several pieces of conditional
language that need to be updated for clarity. Specifically, Conditions 5, 6 and 9 on pages 7 and
8 of the decision include the word 'should'. The conditions would be more clear if rewritten as
below:
Condition 5, second sentence: "Automatic irrigation Sheul he is not required."
Condition 6: "A 30' right-of-way dedication along the south side of 236th Street SW
s" ----Id- "pe is required in accordance with the City's Official Street Map."
Condition 9: "The conditional use permits sheuld shall run with the land and be
transferable."
Also, Condition #2 was already addressed when the applicant submitted the wetland buffer
enhancement plan in Exhibit 1, Attachment F. The language in Condition #2 was holdover from
that in the staff report to the Architectural Design Board in Exhibit 1, Attachment A. The
applicant submitted the buffer plan on September 21, 2016 to address that condition. I should
have removed that condition for the report to the Hearing Examiner but did not. Condition 2
should be eliminated altogether.

Finally, there is a correction for name spelling. On page 3 of the decision, it was 'Taine Wilton'
who provided testimony regarding the construction schedule, rather than 'Kate Wilton'.
