Hi Carrie—
Normally replacements of the same size or smaller size are not charged an impact
fee. This is because the previous structure was “grandfathered” because it was
built before the impact fee was adopted, and the replacement structure is not
creating additional impacts because it is the same size, or smaller size.
If the new structure is bigger than the older structure, an impact fee should be
calculated on the increased square footage, but there is no impact fee for the
square footage equal to the older structure because it is “grandfathered”.

We are trying to interpret the Park Impact Fees in the City Code for a
school.
The situation is that a replacement school is being built for an existing
school. The replacement school is less square footage. The District is
building it on the existing property, then is going to demolish the old
one.
There is a section that deals with residential replacement, but I can’t
find anywhere in the code that addresses commercial or public building
replacements.
What are your thoughts on this?
