As you are aware, no work at the site has been permitted by the City since the associated building permit applications needed to complete the work have not been approved and issued (BLD -2008-0693 and BLD - 2008 -0694). This delay has not been caused by the City but rather because you have not responded to multiple City requests for additional information so that the review may continue regarding the permit applications. The building permit applications will expire on August 12, 2010, and be void. Without action on the building permit applications, the Shoreline Substantial Development Permit for Meadowdale Marina (SM -05-94) will also expire on August 12, 2010, and be void. Please keep in mind, because you have not completed the associated building permit applications and you did not appeal nor apply to the City for remission or mitigation of the $500 per day civil penalty associated with the violation within the specified time period, penalties continue to accrue as provided in the Order to Cease and DesistlNotice of Civil Penalty. As stated in the May 13, 2009 Order and Notice, the violation may only be corrected by obtaining building permit approval to perform the work identified in the Shoreline Substantial Development Permit (SM -05-94) pursuant to the timelines identified in the associated Biological Evaluation. As indicated in the May 13 Order and Notice, the City is currently instituting a review of the approved Shoreline Substantial Development Permit pursuant to Chapter 20.100 ECDC, A Notice of Civil Violation was also posted on May 14, 2009 for failure to obtain a building permit for the pier repair work.
