Subject: Existing deck at 18703 Soundview Place
As part of the City’s review of the Launceford addition at 18703 Soundview Place
(BLD20070695), it was noticed that there is an existing deck on the north side of the
house that encroached into the 10’ side setback. Per ECDC 16.20.040.C:
Uncovered and unenclosed porches, steps, patios, and decks may project into a
required setback not more than one-third of the required setback, or four feet,
whichever is less; provided, that they are no more than 30 inches above ground
level at any point.
The City has no record of a permit being issued for the deck. According to a letter
submitted by the Launceford’s received 6/30/08 (attached), staff had indicated in 1995
that a permit was not required for the installation of the wood deck over the existing
patio as long as it was 18” or less above the existing concrete. While this does not
agree with the code, it is uncertain at this time how the decision was made or who
made it.
As a result, the deck may continue under the nonconforming code (ECDC 17.40). It
may be maintained but may not be expanded in any way that would increase its
nonconformity. Any future work on the deck is subject to all applicable codes and
any structural work must be permitted by the City.
