Subject: BLD20110852 - Retaining Wall @ 1109 121h Avenue North
Dear Mr. & Mrs. Stuart:
I have reviewed the materials submitted for the retaining wall to shore up a failed rockery on your
property at 1109 12`' Avenue North. Since the new retaining wall is more than 3 feet over original grade
and located within the required zoning setbacks, a variance is necessary to permit the retaining wall as
proposed. Enclosed is a Land Use Application form, Variance handout #P6 explaining the variance
criteria and process, and handout #P2 with instructions on how to compile an adjacent property owners
list. Application fees for the variance include: 1) $1,340 for the variance, 2) $15 City of Edmonds permit
surcharge, and 3) $185 sign posting fee for a total of $1,540.
When we spoke at the counter earlier this year, I remember you two were leery of the variance process.
Generally we do not encourage people to apply for variances, but variances are available for just this type .
of circumstance. In order for a variance to be granted all six of the criteria (detailed in the enclosed #P6
handout) must be met. I understand the need for the retaining wall, and the only criteria that I see needing
strong documentation for the proposed retaining wall is criteria number 6, variance is the minimum
necessary. The proposed retaining wall is 8 feet from the base of the rockery and 17 feet from the edge of
the driveway. Documentation should be provided from the geotechnical engineer stating this is the
closest the retaining can be constructed to the rockery. I will work with you to process the variance as
quick as possible assuming you want this up before the raining season arrives in full force.
One more piece of information needed is the amount of fill that will be placed behind the retaining wall.
If the amount of fill is 500 cubic yards or more, the requirement of State Environmental Policy Act
(SEPA) review will be triggered. I am also enclosing a SEPA environmental checklist which will need to
be completed if fill is 500 cubic yards or more. The fee for SEPA review is $485.
