The City of Edmonds has received a request for reasonable accommodation from Charles
Wheeler for his property at 19005 80th Avenue West, Edmonds (Files: STF20120003
and BLD20120202).
Mr. Wheeler has applied for a building permit to build an attached garage which is
currently under review. As part of that permit, front and rear ramps and landings are
proposed in order to provide wheelchair access from the garage to the house. While the
garage meets all required development standards, both sets of landings and ramps project
slightly into the required north and south property line setbacks. Such structures usually
may not be located within a required setback; however, a special exception exists in the
code if handicapped access is being provided.
Chapter 17.05 of the Edmonds Community Development Code (ECDC) was enacted to
authorize staff, when necessary, to reasonably accommodate the statutory rights of the
disabled under the Americans with Disabilities Act, the Fair Housing Act or the
Washington Law Against Discrimination. Staff has determined that the owner is a
disabled veteran as documented in a letter from him and thus qualifies for a reasonable
accommodation. As part of the process, the owner is required to file a covenant with the
Snohomish County Auditor's Office that contains specific conditions; for example, the
accommodation is personal to the owner and does not run with the land. As a result,
if/when the property is sold, the ramps and landings must be removed to meet code
through a demolition permit.
Although not required by city code, this notice is being provided to owners within 300
feet of the subject site. You do not need to do anything as part of this notice — it is for
informational purposes only. However, interested persons — that is, persons located
within 300 feet of the project site — may appeal the reasonable accommodation by filing a
petition for review with Snohomish County Superior Court within 10 days of the date of
mailing of the written notice of decision.
