Neighborhood Notice.pdfDecember 9, 2008 Edmonds Planning Division Courtesy Notice of Application The City has received a "reasonable accommodation" request from Eduardo and Trifenia Laguio for their property at 917 Walnut Street (File STF-2008-0021). The Laguio's are in the process of obtaining the permits necessary to operate a licensed Adult Family Home at the above -referenced location. Adult Family Homes are a permitted use in single-family zones and require a building permit from the City. As part the permitting process, the state is requiring a new handicapped -accessible ramp be constructed. Due to site constraints, the only practical location for the ramp is within a side setback area east of the existing residence. The presence of an elevated ramp in that location will require an approximately 3 -foot vertical extension to a portion of the adjacent fence (which encloses a swimming pool) resulting in a fence greater than six feet in height along a portion of the ramp. In order to allow the ramp to be in the setback and a portion of fence to be greater than six feet, the Laguio's are seeking reasonable accommodation from the strict application of the Edmonds Community Development Code (ECDC). Chapter 17.05 ECDC was enacted to authorize staff, when necessary, to reasonably accommodate the statutory rights of the disabled under the Americans with Disabilities Act, the Fair Housing Act or the Washington Law Against Discrimination. Staff has determined that the applicants will be providing residential care for the disabled based on the licensing application with the state. As part of the approval process, the applicant is required to file a covenant with the Snohomish County Auditor's Office that contains specific conditions; for example, the accommodation is personal to the owners and does not run with the land, so if/when the Adult Family Hoene ceases operation, the ramp and fence extension shall be removed to meet the underlying zoning code by obtaining a demolition permit. Although not required by city code, this notice is being provided to owners within 300 feet of the site. Pursuant to ECDC 17.05.050, a reasonable accommodation is not an administratively appealable decision. Interested persons — that is, persons located within 300 feet of the building site — may appeal the reasonable accommodation by filing a petition for review with Snohomish County Superior Court within 10 days of the date of mailing of the written notice of decision.
