Regarding your request dated January 21, 2015, 1 am granting an administrative noise variance
in accordance with ECC 5.30.120.0.2 for WSDOT to conduct roadway striping activities in
support of the above -referenced project between the hours of 10:00 PM and 7:00 AM for three
(3) nonconsecutive nights between January 23 and June 30, 2015.
It is understood from your submittal that this project was granted atwenty (20) night noise
variance by the Hearing Examiner in May 2014. Project construction began thereafter and ten
(10) of the night variances were used. However, unforeseen construction delays pushed the
roadway striping element of the project past the December 31, 2014 expiration date of that
permit, which necessitated the need for the current request. It is noted that one resident
askFd for ear plugs during one night of the project last year and those were provided; no other
noise complaints were received.
While -three (3) additional nights of noise exceeclance are granted, the following conditions of
approval must be met:
1) The noise mitigation techniques described in the cover letter and noise mitigation plan
for the striping grinder, striping installation truck, and street sweeper shall be
implemented.
2) Per ECC 5.30.1.20.C.2, the applicant must provide notice of the noise variance -to the
police department and must post the site each time the variance is used. The local
residents shall be notified in accordance with -the offered mitigation plan and Mike
Clugston of the Planning Division shall be notified as well.

3) The Project Engineer, John Chi, PE, shall be contacted with any noise complaints within
24 hours of occurrence. Mr. Chi can be contacted at 9025 EI Capitan Way, Everett, WA
98208 or by phone (425-225-8741) or fax (425-225-8798).
4) The granting of this variance does not relieve WSDOT from the requirements of ECC
5.30.130 relating to public disturbance noises.
