I. INTRODUCTION
The applicant has applied for a noise variance (see attached) for up to a 16 hour period on a
Sunday in November to conduct construction activities at the Post Office mixed use building at
201 Main Street. The work proposed at this location has been approved under a separate right-of-
way construction permit, ENG20180138, but the applicant has requested that work at this specific
intersection be approved during the hours 7:00am — 11:00pm on a Sunday, which is outside the
normally approved hours for construction.
The following is staff s analysis and decision on the proposal.
II. FINDINGS AND CONCLUSIONS
A. GENERAL INFORMATION
1. Request: The applicant is requesting a noise variance for work proposed as part of the
Post Office mixed use building project.
2. Review Process: A noise variance is a Type I decision pursuant to ECDC 20.01.003. The
director or his/her designee reviews the project and issues an administrative decision
pursuant to ECDC 20.75.050.C.
3. Project Owners: Edmonds 202 LLC.
4. Applicant: Snohomish County PUD, Debra Lawson.
5. Location: 201 Main Street.

B. PUBLIC CONVENIENCE — Will the work result in significant delays for transportation,
services, or other customer needs if done only during the day and within the hour restrictions
set out in other parts of ECC Chapter 5.30?
This work requires the blocking of the post office loading dock, disrupting normal postal
services if done during normal work hours.
C. PUBLIC SAFETY — Does working at night significantly improve safety conditions for the
traveling public and/or construction workers?
The work is proposed to be done mainly during daylight hours which will provide for the
most reasonable level of safety for workers and the public. Automotive and pedestrian traffic
will be regulated under associated ROW permit STF20170043 previously issued by the City.
D. PUBLIC EXPOSURE — What will be the setting for any proposed work outside of regular
hours? Is it located on an arterial street or in a mostly residential area?
The surrounding buildings are a mix of businesses and multifamily and single family
residential.
E. PUBLIC COSTS — Does a limited amount of authorized work outside of regular hours
established by this chapter save the public significant cost compared to daytime work?
Blocking the loading dock during normal business hours would disrupt the workflow of the
post office, causing delays and potentially additional costs.
F. NOISE REDUCTION MEASURES — Have all reasonable steps been taken to reduce the
impact of any necessary noise outside the standard hours?
It appears that reasonable steps will be taken to minimize noise impacts. Reference the Noise
Reduction section of the Application.
III. DECISION
Based on the Findings of Fact and Conclusions, the following decision is issued by the City of
Edmonds Development Services Department. The noise variance, is APPROVED with the
following conditions:
1. The noise variance is limited to the hours between lam and 1 1pm.
2. The noise variance is granted for work on 1 Sunday in November, date yet to be determined.
The City shall be notified 48-hrs in advance of work start.
3. Construction activity and associated traffic control shall be performed consistent with
separately approved right-of-way construction permit.
4. The grant of a variance shall not relieve any person from the requirements of ECC 5.30.130
relating to public disturbance noises.

Type I permit decisions may be appealed by a party of record to Snohomish County superior
court within 21 days of the date of the decision pursuant to ECDC 20.07.006.

RATIONAL FOR WORK HOUR VARIANCE
Public Convenience:
This work will require that we block the loading lane and loading dock for the Edmonds Post Office. There is no other
access to the transformers.
Our vehicles will set up in the loading lane and in the northbound lane of 2nd Ave N in front of the construction
zone/post office. We will block the northbound lane of 211d Ave N while the crane is in the loading dock removing the
existing transformer. Once the transformer has been removed, the crane will leave and our crew will move their
vehicles into the loading dock area. The approved traffic plan will be utilized and we will try to minimize the time traffic
on 2nd Ave N is restricted. The sidewalk on the east side (where we will be working) is already blocked for construction.
Due to delivery trucks throughout the day, we cannot block the Post Office's loading lane Monday through Saturday
during normal business hours. The trucks arrive multiple times per day beginning at lam until 5:30pm. Working on a
Sunday will avoid the conflict with the Post Office and overnight construction noise to surrounding residential
customers.
Per the owner of the existing, occupied building, he has an emergency generator installed in the building so tenants will
not experience and outage while we work.
Public Safety:
Working during daylight hours instead of overnight will provide the most safety to both our workers and the public.
Public Exposure:
This area consists of mixed use. Many of the businesses in the area are not open on Sunday. We will try to minimize the
time we block the northbound lane to minimize any effect the traffic restriction will have on surrounding businesses and
resident access. The loading dock area is only used by the Post Office and they will be closed. There is no public access
to our work area.
Public Cost:
Because there is no outage expected, there will be no disruption or losses to businesses. Due to the circumstances, this
work must be completed outside normal business hours, therefore there is no additional cost to the public for
performing the work on a Sunday.
Noise Reduction:
Although the residents in the building will hear construction noise, working on Sunday avoids noise during normal
sleeping hours. We will utilize all procedures to avoid excess noise. Working during the day will also avoid the need for
generators to power auxiliary lighting. Once the transformers are boomed in and set, the work consists mostly of our
linemen making connections. There will be no heavy equipment, digging, jackhammering, etc.

The work area is physically enclosed on 3 sides which will contain the noise from the surrounding areas. The main
disturbance will be the crane and truck set up on 2nd Ave N. The crane work should be completed within the first 4-6
hours of work and the plan is for our trucks to move into the loading dock to lessen the impact on 2nd Ave N when the
crane leaves.

will give them instructions on how the emergency generator will work and what areas will have power.
