I. INTRODUCTION
The applicant has applied for a noise variance (Attachment 1) for 2 consecutive days to conduct
construction activities at the intersection of Edmonds Way (SR-104) and 100' Ave W. The work
proposed at this location has been approved under a separate right-of-way construction permit,
ENG20170240, but the applicant has requested that work at this specific intersection be approved
during the hours 8:00pm — 5:00am, which is outside the normally approved hours for construction
(Attachment 2)
The following is staff s analysis and decision on the proposal.
II. FINDINGS AND CONCLUSIONS
A. GENERAL INFORMATION
1. Request: The applicant is requesting a noise variance for work proposed as part of the
OVWSD Sanitary Sewer Upgrade project.
2. Review Process: A noise variance is a Type I decision pursuant to ECDC 20.01.003. The
director or his/her designee reviews the project and issues an administrative decision
pursuant to ECDC 20.75.050.C.
3. Project Owners: Olympic View Water and Sewer District
4. Applicant: Shoreline Construction Co.
5. Location: Intersection of Edmonds Way (SR-104) and 100t' Ave W

B. PUBLIC CONVENIENCE — Will the work result in significant delays for transportation,
services, or other customer needs if done only during the day and within the hour restrictions
set out in other parts of ECC Chapter 5.30?
The location of the proposed construction activities is on State Route 104 - a direct route to
the Edmonds Ferry Terminal, a major bus line, and major transportation corridor into and out
of Edmonds. Should the proposed work be performed during daytime hours it would have
significant impacts to the public.
C. PUBLIC SAFETY — Does working at night significantly improve safety conditions for the
traveling public and/or construction workers?
State Route 104 experiences higher traffic volumes during daytime hours. Rerouting of
traffic through the intersection increases congestion and increases safety concerns.
Performing work at night will significantly reduce exposure to motorists, pedestrians, and
construction workers.
D. PUBLIC EXPOSURE —What will be the setting for any proposed work outside of regular
hours? Is it located on an arterial street or in a mostly residential area?
Work is to be performed on two major arterials — 100t' Ave Wand State Route 104. SR-104
is a direct route to the Edmonds Ferry Terminal, major bus lines and downtown Edmonds.
100t1i Ave W is provides a direct connection between Highway 99, 220'1i St SW, and
downtown Edmonds.
E. PUBLIC COSTS —Does a limited amount of authorized work outside of regular hours
established by this chapter save the public significant cost compared to daytime work?
Expected reduced costs include less idle time for mail service, garbage service, bus service,
etc. In addition, work performed outside of regular hours would have less of an impact to
local businesses.
F. NOISE REDUCTION MEASURES — Have all reasonable steps been taken to reduce the
impact of any necessary noise outside the standard hours?
The applicant has considered the following noise reduction measures:
a) Use electrical over gas/diesel power when feasible
b) Diesel powered equipment to be housed in noise attenuating enclosures when
feasible.
III. DECISION
Based on the Findings of Fact and Conclusions, the following decision is issued by the City of
Edmonds Development Services Department. The noise variance, is APPROVED with the
following conditions:

1. The noise variance is limited to the hours of 8:00pm — 5:00am.
2. The noise variance is granted to perform work over a consecutive 2-day period on dates to be
agreed upon with the City one -week prior to proposed work start.
3. Construction activity and associated traffic control shall be performed consistent with
separately approved right-of-way construction permit.
4. The grant of a variance shall not relieve any person from the requirements of ECC 5.30.130
relating to public disturbance noises.
IV. APPEALS
Type I permit decisions may be appealed by a party of record to Snohomish County superior
court within 21 days of the date of the decision pursuant to ECDC 20.07.006.

Shoreline requests a noise variance for 2 consecutive days to conduct construction activities for an Olympic
View Water and Sewer District (OVWSD) project called Sanitary Sewer Upgrades — Phase 2. The basic
scope of this project is to rehabilitate sewer pipe at various locations. Several of the locations are within the
jurisdiction of City of Edmonds and a Right of Way permit has been issued by City of Edmonds (permit
##ENG20170240). The work for this project can be completed within the conditions of the permit excluding,
the site at Edmonds Way & 100" Ave W.
The work at Edmonds Way & 100'h Ave W is rehabilitating the existing 12" diameter sewer line utilizing
Cured -In -Place Pipe (CIPP), the sewer pipe is within the ROW of Edmonds Way. The pipe wi 11 be
accessed utilizing 2 manholes, one is located in the intersection of 100111 Ave W and the other is
approximately 400 feet west of 100"' Ave W. The process of CIPP requires that the liner be installed, cured
and side sewers reinstatement to be performed in a continuous manner (day 2). The two day plan
(bypassing is required) is as follows:

Edmonds Way is a high volume road surrounded by business. Allowing the work to be performed between
the hours of 8:00 pm to 7:00 am on 2 consecutive nights will:
• Decreased vehicular and pedestrian traffic disruption or delays
• Less disruption to nearby business
• Increased public safety
• Enable work to be completed
This work is planned to take place either the first or second week ut October.
