NOTICE OF CIVIL VIOLATION

Background Information: In the course of reviewing a recent permit application for a swimming pool
on the property it came to the City's attention that the structure indicated as a `garage' on the site plan
contained a separate single family dwelling unit. A search of permit records confirmed -..a „permit to
convert a shop/garage to a guest house in 1968. However there is no permit record of approval for an
Accessory Dwelling Unit (ADU), mechanical work, plumbing work, or converting the guest house into a
single family dwellingunit. Guest Houses are defined in the Edmonds Community Development Code as
a detached structure with not more than two bedrooms accessory to a sin le family.dwelling having no
kitchen facilities used primarily for sleepipg quarters,not occupied by payingtenants and located on a lot
of at least 20,000 square feet in area.
Description of Violation: Remodeling of the guest house into an ADU without advanced City approval
including; a building hermit, plumbing permit, mechanical permit and ADU permit.
Corrective Action Required: 1) Remove all plumbing and mechanical work installed without a permit,
and 2 Remove the kitchen and bathroom and an other non-bearing walls and remand back to the original
configuration of the guest house, OR, 1) Submit a complete permit application including all mquired_plans
and details in order to keep the bathroom and any other non-bearing walls added illegally, AND,
regardless of which option you choose the City shall require that the kitchen (sink, counters, cabinets,
appliances, etc. be removed) and that ou to sigq an AccessoKy Dwelling Unit Covenant form(indicating
that_the guest house shall not be used as an ADU) with appropriate recording fees.
Be advised, the person(s) to whom this Notice is issued is being assessed $100.00 per day, or portion
of a day, during which the violation continues. The imposed monetary penalties are immediately
due and payable to the City of Edmonds at 121 5th Avenue North, Edmonds, WA 98020 during
normal City business hours. Fines shall continue to accrue at the rate of $100.00 per day until this
matter is resolved to the satisfaction of the City.
Further, if correction is not made by 5.00pm (time) October 19, 2007 (date) an abatement notice may
be issued warning of impending City abatement of the violation. Any and all costs, including incidental
costs, will be added to the monetary penalties assessed against the person(s) to whom the Notice is issued.
Note, this decision is appealable to the City of Edmonds Hearing Examiner by filing a complete
appeal application including written notice of appeal with the Development Services Director no
later than October 19, 2007 at 4:30 p.m. The appeal filing fee is $605.00.
