In that time extended time, civil improvement plans had to be reviewed and approved by the City, the civil improvements installed or bonded for, and a final short plat approved by the City and recorded at the County Auditor. You submitted civil plans on October 15, 2015 but those were not completed and an approved final short plat was not recorded by November 17, 2016. Conclusions of Law Edmonds Community Development Code ("ECDC") 20.75.100(B) states: Approval of a short plat shall expire and have no further validity at the end of seven years if preliminary short plat approval is issued on or before December 31, 2013, and five years if preliminary short plat approval is issued on or after January 1, 2014, unless the applicant has acquired final short plat approval within the specified time period. The time period for short plats shall commence upon the issuance of a final, written staff decision. In the event that the decision of staff is appealed to the Edmonds hearing examiner and/or Snohomish County superior court, the time period shall commence upon the date of final confirmation of the preliminary short plat decision by the hearing examiner or judiciary. As noted above, you were notified by the City that the subject preliminary short subdivision approval had been extended by City Council for two years and was due to expire on November 17, 2016. The associated civil plans were not approved and an approved final short plat was not recorded by that date. Decision Because you did not complete the project by November 17, 2016, and pursuant to the above referenced code, the City is hereby issuing this Notice of Type I Action and Decision ("Notice"). No further action will be taken by the City on your application — it has expired and may not be Page 1 of 2 reactivated. If you wish to pursue a short plat at this site in the future, a new preliminary short plat application must be submitted which is designed in accordance with the codes and fees in place at the time of that application.
