ORDINANCE NO. 2151
AN ORDINANCE OF THE CITY OF EDMONDS, WASH-
INGTON, ANNEXING CERTAIN REAL PROPERTY TO
THE CITY PURSUANT TO THE PETITION METHOD;
DESIGNATING THE ZONING CLASSIFICATION FOR
THE NEWLY ANNEXED PROPERTY AS BN; AND ES-
TABLISHING AN EFFECTIVE DATE OF ANNEXATION.
WHEREAS, the City of Edmonds, Washington, has re-
ceived a petition for annexation from the owners of certain
property located in unincorporated Snohomish County, the
legal description of which is set forth below, and
WHEREAS, the proposed annexation was submitted to
the Snohomish County Boundary Review Board and said Board
has waived its jurisdiction pursuant to RCW 36.93.110, and
WHEREAS, pursuant to the petition for annexation,
the City Council has determined that the property shall be
assessed and taxed at the same rate and on the same basis as
property within the City of Edmonds for any existing in-
debtedness of the City, and
WHEREAS, pursuant to RCW 35A.14.330 - .340, the
City Planning Commission has held a public hearing on the
proposed zoning classification for the property to be
effective upon annexation and the City Council has held two
or more public hearings at least thirty (30) days apart upon
the proposed zoning classification, and
WHEREAS, the Planning Commission has forwarded its
recommendations to the City Council in Planning Commission
Resolution No. 656, and
WHEREAS, in accordance with Planning Commission
Resolution No. 656, the City Council has held a public
hearing on the proposed annexation and on the proposed
zoning classification and at the conclusion of said hearing
the City Council has determined the following: -.
1. That the Findings of Fact and Conclusions of Planning
Commission Resolution No. 656 are correct and are
hereby adopted by the City Council in full;
2. The proposed annexation will be in the best interest of
the public health, safety and general welfare and the
proposed zoning classification will not be detrimental
to the surrounding properties or uses either within or
without the City of Edmonds;
3. In accordance with the findings of the City of Edmonds
responsible official, the City Council finds that the
proposed annexation and the proposed zoning classifica-
tion will have no significant adverse environmental
impacts, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. There has been filed with the City
Council of the City of Edmonds, Washington, a petition in
writing, signed by owners of more than 75% in value, according
to the assessed valuation for general taxation of the pro-
perty for which annexation was petitioned; that said petition
set forth a legal description of said real property and said
petition was accompanied by a plat or drawing outlining the
boundaries of the property sought to be annexed; and that
prior to the filing of said petition, the City Council

indicated its tentative approval of such annexation.
Section 2. Tuesday, June 6, 1980, was set as the
date for public hearing on said petition. Notice of such hearing
was published in the Western Sun edition of the Everett Herald,
a newspaper of general circulation in the City of Edmonds and
the area to be annexed. Notice of such hearing was also posted
in three places within the territory proposed for annexation,
said notice specifying the time and place for such hearing and
inviting persons interested to appear and voice approval or
disapproval of the annexation.
Section 3. The territory proposed by said petition to
be annexed to the City of Edmonds is situate in Snohomish County,
Washington, is contiguous, proximate and adjacent to the present
corporate limits of the City of Edmonds and is more particularly
described in Exhibits "A" and "B", attached hereto and incorporated
herein by this reference as if set forth in full.
Section 4. The territory described in Exhibits "A" and
"B" should be, and the same is hereby made a part of the City of
Edmonds.
Section 5. Pursuant to the petition for annexation,
the property newly annexed shall be assessed and taxed at the
same rate and on the same basis as property in the City of
Edmonds for any now outstanding indebtedness of the City, in-
cluding assessments or taxes or payment of any bonds issued or
debts contracted, prior to or existing at the effective date of
this annexation.
Section 6. The official Zoning Map of the City of
Edmonds, Washington, is hereby amended to designate -the zoning
classification of the property described on Exhibits "A" and
"B", as Neighborhood Business (BN).
Section 7. The Director of Community Development and
the Director of Public Works are hereby authorized to effectuate
the necessary amendments to the Official Zoning Map of the City
pursuant to this Ordinance.
Section 8. The City Clerk is hereby directed to record
a certified copy of this Ordinance with the Snohomish County
Auditor and file a certified copy of this Ordinance with the
Snohomish County Council.
Section 9. This Ordinance shall be in full force and
effect and the area annexed shall become a part of the City of
Edmonds five (5) days after passage and publication by posting of
this Ordinance as provided by law.

Commencing at the northwest corner of said subdivision;
thence S 0051'04" W. along the west line of said subdivision,
210.00 feet; thence S 88045'18" E. parallel to the north line
of said subdivision, 37.50 feet to the east margin of 100th
Avenue West and the True Point of Beginning; thence S 0051'04"
W. along said east margin, 119.83 feet to the north line of
the S12, NZT4, MR,-, NE 4, of said section; thence S 88044' 17" E.,
along said north line, 292.12 feet; thence N 0040'16" E.,
