Dear Mr. Papadakis,
The City received a complaint regarding a commercial enterprise being conducted at the subject property. Specifically
the complaint is that wood rounds or trunks are being hauled in and cut along with the associated noise from the
cutting. The Edmonds Community Development Code (ECDC) regulates commercial businesses in residential zones
as follows:
ECDC 20.20 – Home Occupation permit, possible conditional use permit
Edmonds City Code 3.20.030 – Business License required
Under ECDC 16.20.010.B.2, home occupations are a permitted use in residential zones but do require a business
license and home occupation permit. There are seven criteria that must be met to obtain an administrative home
occupation permit. If a home occupation proposal doesn’t meet one or more of the criteria the property owner may
apply for a conditional use permit. There is no guarantee a conditional use permit will be granted if an application is
submitted.
A Home Occupation is to be conducted entirely within the structures on the site, without any significant outside
activity. The purpose of the Home Occupation chapter is to allow residents to carry on home occupations on their
property while guaranteeing neighboring residents freedom from excessive noise, excessive traffic, nuisance, fire
hazard and other possible potential negative impacts from the maintenance of a commercial use within a residential
neighborhood.
Please review the enclosed home occupation criteria carefully. It appears on the surface that a conditional use permit
would be required to run this type of business in a residential zone. Obtaining a conditional use permit would be
difficult because of the outside activity and noise.
Please cease any commercial business enterprise at the subject property by February 28, 2007:
Do not operate any associated machinery or equipment. Do not bring any more wood to the site for the
purpose of commercial sales or trade.
If your tenants desire to run a business at this address, the following corrective actions are necessary prior to
operations:
Make a complete application for a business license, submit fees and obtain a City of Edmonds business
license. (City Clerk’s office – 425-775-2525)
Make a complete application, submit fees and obtain a Home Occupation permit and conditional use permit if
required. (Planning Department)
