Dear Mr. Pauls,
The City has received a complaint regarding a second driveway developed without meeting City standards, junk
vehicles, a commercial vehicle and too many vehicles outside at the subject property. The subject property was
viewed on February 5, 2010.
The current Junk vehicle criteria (effective 1/10/09) is as follows:

6.20.043 Protective coverings.
Except as otherwise expressly provided by applicable city ordinance or a valid regulatory permit, any
condition enumerated in ECC 6.20.040 shall constitute a public nuisance irrespective of whether such condition is
covered in whole or in part by a tarpaulin, vapor barrier, canvas or plastic sheeting, or other temporary covering.
The number of allowed vehicles is regulated in the following code:
ECDC 17.60.040 Vehicles in residential zones
No more than five motor vehicles shall be parked on a residential lot. Each motor vehicle must be

currently licensed and operable.
1. Exemptions.
a. If more than five licensed drivers reside at the same address, an additional motor vehicle for each
licensed driver over five may be parked at that particular address; however, each licensed driver must have that
particular address on his or her license.
b. This regulation does not apply to:
i. Motor vehicles when parked in a rear yard and screened from adjacent properties and
the public right-of-way by a five-foot opaque fence or by a vegetative barrier that is between five feet and eight feet in
height and provides a visual barrier equivalent to an opaque fence. Corner lots and Flag lots which have no rear yard
may establish a screening area which qualifies for this exemption in a side yard.
ii. Temporary parking for a duration not to exceed seventy-two hours;
iii. Apartment or other complex with an approved building and parking plan;
iv. Permitted construction areas; or
v. Motorcycles or mopeds.
Commercial vehicles in residential zones are regulated as follows:

A. No person shall park or store more than one commercial vehicle
licensed gross vehicle weight per dwelling unit on any lot in any R zoned district unless he/she has first obtained a
conditional use permit.
For the purposes of this section, commercial vehicle means any motor vehicle, the principal
use of which is the transportation of commodities, merchandise, produce, freight, vehicles, animals, passengers for
hire, or which is used primarily in construction or farming, including but not limited to bulldozers, backhoes, tractors
and cranes.
As you were advised in the enclosed July 30, 2009 letter, in order to maintain the access on the south side of the
property, you will need to construct a driveway approach per City standards. Edmonds Community Development Code
18.80.060 requires driveway approaches to be paved from the existing street a minimum of 20 feet or the edge of the
property line, whichever is greater. It also appears as though there is an existing drainage ditch along the frontage of
the property. A culvert would need to be constructed in order to maintain storm flows through the ditch, beneath the
driveway approach.
A right-of-way construction permit will be required to perform this work. Please submit a permit application and plan
to the City for review and approval showing the existing edge of pavement, the property line, any utilities within the
vicinity, etc. Indicate storm pipe material to be used and provide invert elevations in the existing ditch (and proposed
pipe) to ensure storm flows are maintained. Ductile iron pipe will be required if 2' of cover over the storm pipe cannot
be obtained.

Corrective actions required:
Please contact me at 425-771-0220 x1716 at your earliest convenience by February 16, 2010 to review your

compliance plan. An Order to Correct is issued if no contact is made.
The Southwest Plumbing truck is 14,000 pounds gross weight. Please remove the commercial truck/van over

10,000 pounds gross weight or make a complete application for a conditional use permit by March 1, 2010.
Please make a complete application for a right-of-way construction permit for the new driveway by March 1,
·
2010 or, per the July 30, 2009 letter, refrain from using the informal access points, and limit the vehicular
access to your property to that driveway built with the original house.
Please remove any vehicles over 5 unless meeting the exemption of ECDC 17.60.040.1.a.

Remove or enclose all vehicles that are not currently licensed (please note that a tarp, cover or pliable
·
tent/canopy is not considered enclosed) by March 1, 2010.
