After a conversation with Anne Bullis in your office yesterday, we are forwarding
you this information today while another exhibit is still being prepared by our
attorney. Enclosed are:
• Letter from our architect, George Ostrow of Velocipede Architects,
describing the change that we are applying for (and that I believe he has
discussed with you as to necessary content),
• A copy of the Reciprocal Parking Agreement between the several parties
owning the property at the former Albertson's site, which was enclosed
earlier in a letter or inquiry from Woodman Construction, and
A map of the tax parcels covering the area in question and a map of the
property lines surrounding the storefront.
What is being drafted at this time now that we have received a (slightly dated)
title report from. the Lessor, is the legal contract that we will propose to the City of
Edmonds.
By way of a quick background, we are enclosing the Reciprocal Parking
Agreement (RPA) because we believe it will minimize risk to the City regarding
enforcement of the options we would like to propose in the contract between
ourselves and the City.
The RPA entitles the tenant of the former Albertson's building to use all of the
space currently not built upon in, the tax parcel that abuts the storefront for the
purpose of parking for the full length of the ground lease, which expires at the
end of 2040. Should PCC negotiate a lease for the storefront, we will thereby
have the legal standing to insist on that space remaining in use as a parking lot
Community -owned
andoperated
and thus not being built upon. This gives us the means to assure the open space
in front of the storefront that we are asking for permission to define as a "yard" to
the store.
The enclosed sketch identifies the tax parcels involved and the location of the
storefront on the property.
Because, as your office has pointed out to us, the RPA does not directly involve
the City of Edmonds, we are drafting a contract between PCC and the City of
Edmonds for your consideration that will guarantee performance by PCC. In it,
PCC will be accountable directly to the City to preserve the yard that we are
petitioning for such that, should for any reason in the future the yard not be
preserved, PCC would be legally obligated to remove the storefronts that would
abut the proposed yard and restore the solid wall that had been altered by
installing the storefronts.
We are anticipating that the contract document will be available to review with
you or the City attorney in the next few days.
